PLANO, Texas
Dr. Samad Khan, a Frisco physician and owner of SK Primary Care, has agreed to pay $3.5 million to settle allegations he violated the False Claims Act by billing the federal COVID-19 Uninsured Program for medical services that were never performed.
Federal authorities allege that from April 2020 to October 2021, Khan knowingly submitted approximately 400,000 false claims for higher-level evaluation and management (E/M) services at COVID testing sites across Texas.
These sites—mostly drive-through or walk-up operations—were staffed by medical assistants, not physicians or qualified health professionals.
The services provided at these sites were limited to nasal swab specimen collection, which qualified only for lower-level billing codes.
However, Khan allegedly used higher-paying CPT codes intended for complex office visits, despite never seeing patients in person or through telehealth. In many cases, even test results were delivered through scripted calls or text messages, not by licensed professionals.
The claims resolved by the settlement are allegations only and there has been no determination of liability.
The Justice Department says Khan and his management company inflated claims by submitting duplicate charges—one for testing and another for giving results—without any actual E/M services provided.
These fraudulent claims resulted in millions of dollars in overpayments from the Health Resources & Services Administration.
