Trump, in his reckless way, just handed defense lawyers a gift. By ranting on social media about prosecuting his political enemies, he opened the door for defendants to argue malicious and unlawful prosecution under color of law.That puts Pam Bondi in the crosshairs. Subpoenas could drag her emails, calls, and files into the open—and force her to testify whether she’s taking Trump’s marching orders online. If so, she’s not a prosecutor. She’s his enforcer.
Good defense lawyers would line up recent DOJ prosecutors who abruptly resigned to testify about the marching orders given by Bondi.
Is Bondi already an accomplice in Trump’s unlawful conduct?
The Constitution is clear: prosecutions must be impartial. The Supreme Court has stated outright that prosecutors must be disinterested (Young v. U.S. ex rel. Vuitton, 1987). If Bondi is working as Trump’s political hitwoman, every case she touches collapses.
There might be other cases she is prosecuting for Trump that need judicial scrutiny.
Also, the American Bar Association Model Rules of Professional Conduct (Rule 1.7, Rule 1.11) prohibit attorneys — including prosecutors — from malicious and unlawful prosecution. Lawyers can lose their law licenses.
And let’s not forget—Bondi already faces legal trouble in Florida, as Newsweek reported in June 2025. That’s the person Trump wants swinging the axe for him.
