Robert G. Lustyik Jr<\/figcaption><\/figure>\n

UTAH<\/b> – A former FBI special agent, who a prosecutor said “sold his badge” to “the highest bidder,” was sentenced Monday to 10 years in prison, according to authorities.<\/p>\n<\/div>\n

Robert G. Lustyik Jr<\/strong>., 52, of Sleepy Hollow, New York, a 24-year veteran of the FBI, plead guilty to all charges in an 11-count indictment on Sept. 29, 2014, officials said.<\/div>\n
<\/div>\n
Lustyik was soliciting and accepting bribes to obstruct a federal grand jury investigation into an alleged kickback scheme involving a defense contractor, according to authorities.<\/div>\n
<\/div>\n
He was ordered to forfeit $70,000.<\/div>\n
<\/div>\n
\u00a0Lustyik will be sentenced on April 30 in New York.<\/div>\n
<\/div>\n
Lustyik’s hearing was followed by sentencing hearings for two other men \u2014 Michael L. Taylor and Johannes W. Thaler \u2014 who were charged as defendants in the same scheme, according to the Salt Lake Tribune.<\/a><\/div>\n
<\/div>\n
All three men pleaded guilty to separate indictments in 2013 and 2014.<\/div>\n
<\/div>\n
“I have embarrassed my family,” Lustyik told Campbell, according to the Salt Like Tribune. “I’ve left a black mark on the FBI \u2026 I had a stellar career and I ruined it.”<\/div>\n
<\/div>\n
Prosecutors were able to retrieve damaging emails from the defendants to shore up their case.<\/div>\n
<\/div>\n
The investigation was conducted by the U.S. Department of Justice Office of Inspector General.<\/strong><\/div>\n
<\/div>\n
\u201cFBI agents\u2014like all federal law enforcement\u2014must be above reproach, but former Special Agent Lustyik sold his badge and position of public trust to the highest bidder,\u201d said Assistant Attorney General Leslie Caldwell<\/strong>.\u00a0 \u201cThis sentence serves as a stark reminder that no one is above the law.\u00a0 Corrupt officials who break the law and breach their oaths will be prosecuted and sent to prison, even if they come from within the ranks of federal law enforcement.\u201d<\/div>\n

Specifically, Lustyik pleaded guilty to conspiracy to commit bribery and obstruction, eight counts of honest services wire fraud, obstruction of a grand jury investigation and obstruction of an agency proceeding.<\/p>\n

Lustyik\u2019s co-defendants, Michael L. Taylor<\/strong>, 54, of Harvard, Massachusetts, and Johannes W. Thaler,<\/strong> 51, of New Fairfield, Connecticut, were also sentenced Monday to 24 months in prison and 13 months in prison, respectively, for their roles in this scheme.<\/p>\n

U.S. District Senior Judge Tena Campbell<\/strong> of the District of Utah sentenced the trio.<\/p>\n

Lustyik<\/strong> and Thaler<\/strong> both plead guilty for their involvement in a similar bribery scheme in New York.\u00a0 Thaler was sentenced to 30 months in prison in that case, and will serve the two sentences consecutively, officials said.<\/p>\n

\u201cThese three defendants attempted to thwart a significant criminal investigation in Utah,\u201d said U.S. Attorney Carlie Christensen.<\/strong> \u00a0\u201cTwo of these defendants were entrusted with protecting our citizens and upholding the law.\u00a0 Their conduct, in particular, stands in stark contrast to the integrity and sacrifice of the men and women in our military and law enforcement ranks and their sentences today send a powerful message that no one is above the law.\u201d<\/p>\n

According to court documents, these are the facts and circumstances surrounding this case:<\/strong><\/p>\n

    \n
  • From October 2011 to September 2012, Lustyik and Thaler conspired to use Lustyik\u2019s official position as an FBI counterintelligence special agent to obstruct a criminal investigation into Taylor, a businessman who owned and operated American International Security Corporation.\u00a0<\/strong><\/li>\n
  • Taylor was under investigation for allegedly paying kickbacks to obtain a series of contracts from the Department of Defense<\/strong> worth approximately $54 million.<\/li>\n
  • Taylor promised Lustyik and Thaler that, in exchange for their help, he would provide them cash and multimillion dollar business contracts.<\/li>\n
  • In an email message, Taylor told the two men, \u201cI\u2019ll make you guys more money than you can believe, provided they don\u2019t think I\u2019m a bad guy and put me in jail.\u201d<\/li>\n<\/ul>\n

    Obstruction of Justice<\/strong><\/p>\n

    According to court documents, Lustyik attempted to obstruct the investigation into Taylor by identifying Taylor as an official FBI confidential source in an effort to persuade the FBI, the Justice Department and the prosecutors and law enforcement agents in Utah that Taylor\u2019s usefulness to the government outweighed the government\u2019s interest in prosecuting him.<\/p>\n

    Indeed, Lustyik emphasized that indicting Taylor would threaten the nation\u2019s security.\u00a0 Lustyik also sought to take steps to directly intervene in the investigation by interviewing key witnesses.<\/p>\n

    According to court documents, the defendants boasted about the success of their scheme.\u00a0<\/strong><\/p>\n

    In one email message, Lustyik wrote to Taylor, \u201cThe rate this is going.\u00a0 I will be indicted way before u ever are !!\u201d\u00a0 Lustyik wrote separately to Thaler, \u201cI can leave [the FBI] in June. \u00a0But I\u2019m afraid to if [Taylor] gets indicted n I\u2019m not an agent I\u2019m no help. \u00a0Has he mentioned giving me\u2010u a salary?\u201d<\/p>\n

    Taylor admitted at his plea hearing that, as part of this conspiracy, he offered Lustyik a six-figure salary and a share of the proceeds from various multi-million dollar business deals he was pursuing.<\/p>\n

    Acknowledging this, Lustyik wrote to Taylor, \u201cLet\u2019s just get Utah over with and get stinking rich,\u201d to which Taylor replied, \u201cGetting stinking rick [sic], we are well on the way with that so I have the ball.\u201d<\/p>\n

    \u201cToday\u2019s sentencings represent important steps toward justice in this case,\u201d said Inspector General Michael Horowitz<\/strong>.\u00a0 \u201cDepartment of Justice employees and their associates must be held accountable when they abuse their authority and betray the public\u2019s trust.\u201d<\/p>\n<\/div>\n
