{"id":10631,"date":"2015-04-02T15:22:50","date_gmt":"2015-04-02T22:22:50","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=10631"},"modified":"2015-04-02T15:34:12","modified_gmt":"2015-04-02T22:34:12","slug":"seven-charged-with-paying-kickbacks-to-an-official-of-a-boeing-company-subsidiary","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=10631","title":{"rendered":"Seven Charged With Paying Kickbacks to an Official of a Boeing Company Subsidiary"},"content":{"rendered":"<p><strong><a href=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/11\/usdojseal.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-7674\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/11\/usdojseal-150x150.jpg\" alt=\"usdojseal\" width=\"150\" height=\"150\" \/><\/a>LOS ANGELES<\/strong> \u2013 Seven defendants have been charged in a scheme to pay\u00a0kickbacks to a procurement official of a subsidiary of the Boeing Company that supplies\u00a0satellites and satellite parts to federal government entities, including NASA, the U.S. Department of Justice announced today.<\/p>\n<p>Four of the defendants have plead guilty in another related case, officials said.<\/p>\n<p>An executive at a San Gabriel Valley metal company, <strong>Alfred Henderson<\/strong>, that was a subcontractor to <strong>Boeing Space and Intelligence Systems<\/strong>, \u00a0which supplies\u00a0satellites and satellite parts to<strong> NASA<\/strong>, the <strong>Department of Defense<\/strong>, the <strong>National\u00a0Reconnaissance Office<\/strong> and the<strong> U.S. Air Force.<\/strong><\/p>\n<p><strong><a href=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/04\/Boeing-Logo.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-10640\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/04\/Boeing-Logo-150x150.jpg\" alt=\"Boeing Logo\" width=\"150\" height=\"150\" \/><\/a>Henderson<\/strong>, 60, of Pico Rivera, who is the vice president of<strong> A&amp;A Fabrication and Polishing,\u00a0Inc.<\/strong>, which operates in Whittier and Montebello was arrested on Monday.<\/p>\n<p>He was arraigned\u00a0<span style=\"line-height: 1.5;\">on a 15-count grand jury indictment that was unsealed after his arrest.<\/span><\/p>\n<p>A&amp;A is also\u00a0charged in the indictment.<\/p>\n<p><strong>Henderson<\/strong> plead not guilty and\u00a0released on a $25,000 bond. He is due back in court in May.<\/p>\n<p>Lawyers representatives of A&amp;A will appear on behalf of the\u00a0company in federal court on April 13.<\/p>\n<p>A&amp;A is a company that specializes in machining, welding and producing sheet metal\u00a0for industries that include aerospace. A&amp;A manufactured tooling parts that Boeing used to\u00a0manufacture satellites.<\/p>\n<p>The indictment alleges that Henderson and A&amp;A paid kickbacks to <strong>Mark Allen, 60,\u00a0of Fresno<\/strong>, who was a procurement officer at Boeing in El Segundo.<\/p>\n<p>The kickbacks were paid\u00a0to Allen through an outside sales representative,<strong> Raymond Joseph, 66, of Los Angeles,<\/strong>\u00a0related to purchase orders to A&amp;A for tooling parts used to manufacture of satellites that<br \/>\nwere sold to the U.S. Government.<\/p>\n<p>The indictment alleges that <strong>Allen<\/strong> provided <strong>Henderson<\/strong>\u00a0with confidential information that gave A&amp;A an improper advantage in bidding and ensured that A&amp;A would receive purchase orders from Boeing.<\/p>\n<p>The indictment also alleges that after Boeing decided to stop doing business with\u00a0A&amp;A due to work quality and performance issues,<strong> Henderson<\/strong> devised a scheme to do\u00a0business through a \u201cfront\u201d company, <strong>Nace Sheet Metal Company,<\/strong> which was owned and operated by <strong>Cesar Soto, 47, of Chino.<\/strong><\/p>\n<p>The indictment against <strong>Henderson<\/strong> alleges that <strong>Soto\u00a0<\/strong>and an <strong>A&amp;A employee, Randy Mitchell, 62,<\/strong> of Whittier, misrepresented that A&amp;A\u2019s facility\u00a0was actually operated by <strong>Nace<\/strong> and that <strong>Henderson<\/strong> unlawfully used<strong> Soto\u2019s<\/strong> name on price\u00a0quotes to Boeing.<\/p>\n<p>The indictment further alleges that <strong>Henderson<\/strong> and <strong>A&amp;A<\/strong> issued false tax\u00a0forms to Joseph, which he used to understate his taxable income to the Internal Revenue<br \/>\nService.<\/p>\n<p>\u201cPay-to-play schemes undermine the integrity of the competitive bidding process\u00a0and, in this case, compromised the quality of products used to manufacture satellites for\u00a0scientific exploration and national defense,\u201d said <strong>Acting United States Attorney Stephanie\u00a0Yonekura<\/strong><\/p>\n<p>In a court order filed late Tuesday, U.S. District Judge Otis D. Wright II,\u00a0<span style=\"line-height: 1.5;\">unsealed criminal cases against <strong>Mark Allen, Raymond Joseph, Cesar Soto,<\/strong> and <strong>Randy\u00a0<\/strong><\/span><strong><span style=\"line-height: 1.5;\">Mitchell. <\/span><\/strong><\/p>\n<p><span style=\"line-height: 1.5;\">All four previously pleaded guilty and are pending sentencing.<\/span><\/p>\n<p>The U.S. Attorney\u2019s Office on Monday filed a criminal information against\u00a0the seventh defendant in this scheme \u2013<strong> Noberto Martinez, 53, of Alhambr<\/strong>a, who owns and\u00a0controls <strong>Zenitram Engineering and Manufacturing, Inc.<\/strong><\/p>\n<p>The information charges <strong>Martinez <\/strong>with conspiring to pay kickbacks to <strong>Allen<\/strong> and issuing false tax forms to Joseph. <strong>Martinez<\/strong>\u00a0has signed a plea agreement and is scheduled to make his first court appearance on April
