{"id":1557,"date":"2014-03-13T14:43:54","date_gmt":"2014-03-13T21:43:54","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=1557"},"modified":"2014-03-13T22:32:26","modified_gmt":"2014-03-14T05:32:26","slug":"feds-want-stop-ohio-youth-services-putting-boys-juvenile-correction-facilities","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=1557","title":{"rendered":"Feds Want to Stop Ohio Youth Services from Putting Mentally Ill Boys in Juvenile Correction Facilities"},"content":{"rendered":"<p>OHIO &#8212; The U.S. Department of Justice today sought a temporarily restraining order against the Department of \u00a0Youth Services from putting boys with mental health needs in its juvenile correction facilities, according to prosecutors.<\/p>\n<p>The court order claims that Youth Services&#8217; practice violates the constitutional rights of boys in custody, authorities said.<\/p>\n<p>The department sought to also expand its existing complaint against another facility, the Scioto Juvenile Correction Facility, to include claims of doing the same thing.<\/p>\n<p>\u201cThe facts in this case reveal a serious disregard for the rights of young people with mental health needs in Ohio\u2019s custody,\u201d said U.S. Attorney Steven M. Dettelbach for the Northern District of Ohio. \u201cThe Ohio Department of Youth Services has a responsibility to ensure the health and safety of these young people, including providing appropriate mental health treatment, so that they can overcome challenging behaviors and return to the community to become successful adults.\u201d<\/p>\n<p><span style=\"line-height: 1.5em;\">The department detailed the state\u2019s excessive use of seclusion, including the following information:<\/span><\/p>\n<ul>\n<li>\u00b7 In the second half of 2013, the state imposed a total of almost 60,000 hours of seclusion on 229 boys with mental health needs.<\/li>\n<li>\u00b7 One boy spent 1,964 hours in seclusion over six months; the state gave another boy 21 straight days of seclusion.<\/li>\n<li>\u00b7 Ten boys at one facility spent over 10 percent of their time in custody in seclusion.<\/li>\n<li>\u00b7 While secluded, several boys were on suicide watch, had suicidal thoughts or hurt themselves.<\/li>\n<\/ul>\n<p>The Justice Department issued findings in May 2007 detailing significant constitutional deficiencies regarding use of physical force, grievance investigation and processing and use of seclusion, officials said.<\/p>\n<p><a href=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/DYSLogo.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-1562\" alt=\"DYSLogo\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/DYSLogo-150x150.jpg\" width=\"150\" height=\"150\" \/><\/a>The\u00a0<span style=\"line-height: 1.5em;\">Justice Department issued findings in May 2007 detailing significant constitutional deficiencies regarding use of physical force, grievance investigation and processing and use of seclusion.<\/span><\/p>\n<p><span style=\"line-height: 1.5em;\"> In June 2008, the department entered into a consent decree with the state to correct these deficiencies at the Scioto Juvenile Correctional Facility.\u00a0<\/span><\/p>\n<p><span style=\"line-height: 1.5em;\"> However, \u00a0Youth Services \u00a0continued to unlawfully seclude boys with mental health needs at Scioto Juvenile Correctional Facility and had moved boys to other facilities also using unlawful seclusion.<\/span><\/p>\n<p>This resulted in the Justice Department to seek the temporary restraining order
