O\u2019Mara,<\/strong> 54, of Buffalo, NY, was working as a paid musical director and church organist which involved the use of the same arm O&#8217;Mara claimed he injured in 2005, according to authorities.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">O&#8217;Mara, a former Buffalo Police lieutenant, was convicted of wire fraud related to falsely claiming he had been injured, officials said.<\/span><br \/>\n<iframe loading=\"lazy\" src=\"http:\/\/up.anv.bz\/latest\/anvload.html?key=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\" width=\"640\" height=\"360\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>These are the facts surrounding this case:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\"><strong>Assistant U.S. Attorney John E. Rogowski<\/strong>, who handled the case, stated that in February, 2004, the defendant, a Buffalo Police Officer, was placed on Injured on Duty Status \u00a0by the City of Buffalo.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">O\u2019Mara was placed on injury status for cervical and lumbar strains suffered while on duty.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">The defendant remained on injury status until October, 2004 when he was ordered to return to light duty.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">In 2005, O\u2019Mara again claimed to have injured his right arm, this time while purportedly lifting two reams of copy paper.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">While the defendant did not report the injury to his superiors until 23 days later, the defendant was placed on IOD status once again in September, 2005, where he remained up until 2102, the time he was initially arrested and charged in this case.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Following the defendant\u2019s arrest, the defendant filed for retirement from the Police Department.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">During the course of the investigation, the Government learned that the defendant\u2019s primary care physician did not recommend that O\u2019Mara return to work. Contradicting this position, several independent medical exams concluded that the defendant was not permanently disabled.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">One doctor noted that the defendant walked into his office using a cane, but later witnessed O\u2019Mara walking in the parking lot without any limp.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Additional investigation determined that the defendant was working another job while simultaneously claiming he was too injured to perform even light duty for the Buffalo Police Department.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">The work involved serving as a paid musical director and church organist which involved the use of the same arm the defendant claimed he injured in 2005 while lifting the lifting the two reams of paper.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">At the time of the defendant\u2019s arrest in May, 2012, the defendant admitted that he was capable of performing light duty for the Police Department.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">The defendant claimed that the reason he stayed on injury on duty\u00a0status\u00a0was that he considered it to be \u201cdemeaning\u201d to sit at a desk and answer the telephone, and further, that the pay he received while on injury status was an incentive to remain off-duty since the pay was tax-free.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">In Court, the defendant attributed his fraud to being \u201cgreedy.\u201d<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">O\u2019Mara\u2019s was one of two Buffalo Police Officers charged with defrauding the injury program.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Since the filing of both cases by the Government, the number of Buffalo Police officers on injury status has declined from well over one hundred officers to under 20.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">The second defendant charged in connection with the injury investigation, Robert Quintana, is pending trial for mail and health care fraud.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 14pt;\">The defendant is presumed innocent until proven guilty.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The FBI and the Buffalo Police Department investigated this
