{"id":18441,"date":"2015-12-18T11:59:31","date_gmt":"2015-12-18T19:59:31","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=18441"},"modified":"2015-12-18T11:59:31","modified_gmt":"2015-12-18T19:59:31","slug":"dea-report","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=18441","title":{"rendered":"32 Hospitals in 15 States to Pay More Than $28 Million for Falsely Billing Medicare"},"content":{"rendered":"<p><span style=\"font-size: 14pt;\"><strong>NEW YORK<\/strong><\/span><\/p>\n<hr \/>\n<p><span style=\"font-size: 14pt;\">Thirty-two hospitals located throughout 15 states have agreed to pay the federal government more than $28 million to settle allegations that the health care facilities submitted false claims to Medicare for minimally-invasive <a href=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/Justice-Depart.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-8666 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/Justice-Depart-300x300.jpg\" alt=\"Justice-Depart\" width=\"300\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/Justice-Depart-300x300.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/Justice-Depart-150x150.jpg 150w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/Justice-Depart.jpg 320w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><strong>kyphoplasty procedures,<\/strong> the Justice Department announced today.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>Kyphoplasty<\/strong> is a minimally-invasive procedure used to treat certain spinal fractures that often are due to osteoporosis.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Justice Department officials said they already reached settlements with more than 130 hospitals totaling approximately $105 million to resolve allegations that they inaccurately charged Medicare for kyphoplasty procedures.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The case was brought to light by a whistleblower under the federal <strong>False Claims Act,<\/strong> according to officials.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">In many cases, officials said the procedure can be performed safely and effectively as an outpatient procedure without any need for a more costly inpatient hospital admission.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The settlements announced today resolve allegations that the 32 settling hospitals frequently billed Medicare for kyphoplasty procedures on a more costly inpatient basis, rather than an outpatient basis, in order to increase their Medicare billings, according to officials.<\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">\u201cCharging the government for higher cost inpatient services that patients do not need wastes the country\u2019s vital health care dollars,\u201d said<strong> Deputy Assistant Attorney General Benjamin C. Mizer, head of the Justice Department\u2019s Civil Division.<\/strong>\u00a0 \u201cThe Department of Justice is committed to ensuring that Medicare funds are expended appropriately, based on the medical needs of patients rather than the desire to maximize hospital profits.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 14pt;\"><strong>The settling facilities and the amounts they have agreed to pay, include the following:\u00a0<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\">The Cleveland Clinic in Cleveland, Ohio, has agreed to pay $1.74 million.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Citrus Memorial Health System in Inverness, Florida, has agreed to pay $2.6 million.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Cullman Regional Medical Center in Cullman, Alabama, has agreed to pay $350,000.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Martin Memorial Medical Center in Stuart, Florida, has agreed to pay $2 million.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">MultiCare Tacoma General Hospital in Tacoma, Washington, has agreed to pay $983,000.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Norwalk Hospital in Norwalk, Connecticut, has agreed to pay $920,000.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Princeton Community Hospital Association in Princeton, West Virginia, has agreed to pay $1,513,500.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Sacred Heart Medical Center in Spokane, Washington, has agreed to pay $906,000.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Sarasota Memorial Hospital in Sarasota, Florida, has agreed to pay $972,000.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Spartanburg Regional Health Services District Inc. in Spartanburg, South Carolina, has agreed to pay $1.725 million.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">St. Cloud Hospital in St. Cloud, Minnesota, has agreed to pay $500,000.<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Tampa General Hospital in Tampa, Florida, has agreed to pay $2 million.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 14pt;\">\u201cAs has been shown throughout this successful investigation, we will never allow hospitals to put profits ahead of patients,\u201d said <strong>U.S. Attorney William J. Hochul Jr. of New York.<\/strong> \u201cDecisions regarding potential procedures should be made using sound medical judgment only, not with an eye toward increasing Medicare reimbursements. The public should be assured that any hospital involved in improper kyphoplasty billing will be held accountable for its actions.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Five hospitals affiliated with <strong>Community Health Systems Inc.,<\/strong> in Franklin, Tennessee, have agreed to pay a total of $3.5 million.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong>These hospitals include the following<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\">Crestwood Medical Center in Huntsville, Alabama<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">St. Joseph\u2019s Hospital in Fort Wayne, Indiana<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Carolinas Hospital System in Florence, South Carolina<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Mary Black Health System in Spartanburg, South Carolina<\/span><\/li>\n<li><span style=\"font-size: 14pt;\">Trinity Medical Center in Birmingham, Alabama.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 14pt;\">Five hospitals affiliated with <strong>Tenet Health Care Corporation in Dallas, Texas,<\/strong> have agreed to pay a total of $2.2 million.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">These include the following hospitals: East Cooper Medical Center in Mt. Pleasant, South Carolina; North Fulton Hospital in Roswell, Georgia; Providence Memorial Hospital in El Paso, Texas; St. Francis Hospital in Memphis, Tennessee; and Sierra Medical Center in El Paso.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Five hospitals formerly owned and operated by <strong>Health Management Associates Inc.,<\/strong> in Naples, Florida, have agreed to pay a total of $2 million.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">These include the following hospitals: Biloxi Regional Medical Center in Biloxi, Mississippi; Davis Regional Medical Center in Statesville, North Carolina; Lancaster Regional Medical Center in Lancaster, Pennsylvania; Physicians Regional Medical Center in Naples, Florida; and Riley Hospital in Meridian, Mississippi.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Three hospitals affiliated with <strong>BayCare Health System in Clearwater, Florida<\/strong>, have agreed to pay a total of $1.5 million.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">These include the following hospitals: Winter Haven Hospital in Winter Haven, Florida; St. Joseph\u2019s Hospital in Tampa, Florida; and St. Anthony\u2019s Hospital in St. Petersburg, Florida.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Two hospitals affiliated with <strong>Banner Health in Phoenix, Arizona<\/strong>, have agreed to pay a total of $2.685 million.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">These include the following hospitals: \u00a0Banner Boswell Medical Center in Sun City, Arizona, and Banner Thunderbird Medical Center in Glendale, Arizona.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">In addition to settlements with over 130 hospitals, the government previously settled with <strong>Medtronic Spine LLC,<\/strong> the corporate successor to Kyphon Inc., for $75 million to settle allegations that the company caused false claims to be submitted to Medicare by counseling hospital providers to perform kyphoplasty procedures as inpatient rather than outpatient procedures.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">All but three of the settling facilities announced today were named as defendants in a qui tam, or whistleblower, lawsuit brought under the False Claims Act, which permits private citizens to bring lawsuits on behalf of the United States and receive a portion of the proceeds of any settlement or judgment awarded against a defendant.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The lawsuit was filed in federal district court in Buffalo, New York, by<strong> Craig Patrick and Charles Bates.<\/strong>\u00a0 Patrick is a former reimbursement manager for Kyphon, and Bates was formerly a regional sales manager for Kyphon in Birmingham.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The whistleblowers will receive a total of approximately $4.75 million from the settlements announced today.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">One of the most powerful tools in this effort is the False Claims Act, federal officials said.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Since January 2009, the Justice Department said they have recovered a total of more than $26.7 billion through False Claims Act cases, with more than $16.8 billion of that amount recovered in cases involving fraud against federal health care programs<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">The claims resolved by these settlements are allegations only, and there have been no determinations of liability, officials
