The German shipping companies Briese Schiffahrts GmbH & Co. KG and Briese Schiffahrts GmbH & Co. KG MS \u201cExtum,\u201d who owned and operated the cargo ship M\/V BBC Magellan, plead guilty today illegally dumping oil into the ocean, according to officials.<\/span><\/p>\n

The companies admitted to\u00a0failure to maintain an accurate oil record book, in violation of the Act to Prevent Pollution from Ships.<\/span><\/p>\n

The companies also admitted to tampering with witnesses by persuading them to provide false statements to the U.S. Coast Guard concerning a bypass hose on the vessel that was being used to discharge oil into the sea, according to officials.<\/span><\/p>\n

The two companies were sentenced to pay a total of $1.25 million in fines and a $250,000 community service payment to the National Fish and Wildlife Foundation.<\/span><\/p>\n

The Wildlife Foundation money will be used to fund projects that enhance coastal habitats of the Gulf of Mexico and bolster priority fish and wildlife populations. \u00a0<\/span><\/p>\n

In addition, officials said the ship M\/V BBC Magellan is banned from doing business in the U.S. for the next five years.\u00a0 <\/span><\/p>\n

\u201cShipping companies that transport commerce across open seas must respect the international laws and obligations of their trade, which exist to prevent the spoiling of oceans and marine habitat,\u201d said Assistant Attorney General John C. Cruden.\u00a0<\/strong> \u201cThis egregious behavior by shipping companies, which included intentional deception and witness tampering, will not be tolerated. We will continue to prosecute companies and their officers for these crimes.\u201d<\/span><\/p>\n

The operation of a marine vessel, such as the M\/V BBC Magellan, generates large quantities of waste oil and oil-contaminated waste water.\u00a0<\/span><\/p>\n

“Our fleet of\u00a0more than\u00a0130\u00a0seagoing vessels within the multipurpose and heavy lift sector, all of which are equipped to the highest technical standards, provides qualified marine transport services including single-source transport logistics,” according to\u00a0Briese Schiffahrts GmbH & Co. KG<\/span><\/p>\n

“A shore office staff of over 225 highly qualified employees, and over 2,000 qualified and fully trained staff on board our vessels, guarantees transport solutions tailored to your needs world wide,” the website states.<\/span><\/p>\n

.International and U.S. law requires that these vessels use pollution prevention equipment to preclude the discharge of these materials.\u00a0 Should any overboard discharges occur, they must be documented in an oil record book, a log that is regularly inspected by the U.S. Coast Guard.<\/span><\/p>\n

In March 2015, during an inspection at the Port of Pensacola, the U.S. Coast Guard discovered an improperly attached rubber hose.\u00a0 <\/span><\/p>\n

Officials later determined that, between January and March 2015, the crew of the M\/V BBC Magellan, acting on behalf of the vessel\u2019s owner, illegally used the rubber hose to remove oily wastes from the vessel\u2019s holding tanks and dump it into the ocean.\u00a0 <\/span><\/p>\n

The crew also failed to make the required entries in the vessel\u2019s oil record book.\u00a0 When questioned about the hose\u2019s purpose and how oily wastes were discharged from the ship, the chief engineer instructed other crew members to lie to the Coast Guard, according to authorities.<\/span><\/p>\n

\u201cFuture generations deserve to enjoy clean and safe coastal waters, and we will continue to prosecute environmental crimes to prevent pollution of our natural resources,\u201d said Acting U.S. Attorney Christopher Canova<\/strong>.\u00a0 \u201cOur federal environmental laws rightfully require companies to record their oil waste disposal to keep them accountable and to protect our oceans and marine life.\u201d<\/span><\/p>\n

\u201cWhen a company knowingly fails to comply with our nation\u2019s environmental laws, it can have a devastating effect on both public health and wildlife,\u201d said Acting Special Agent in Charge Andy Castro of the Environmental Protection Agency\u2019s criminal enforcement program in Florida.<\/strong> \u00a0\u201cThe defendants in this case falsified entries in their vessel\u2019s log books to hide the true nature of its open water discharges. \u00a0Today\u2019s court action should signal to would-be violators that the American people will not allow the flagrant violation of U.S. laws.\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
