{"id":21574,"date":"2016-03-21T20:15:10","date_gmt":"2016-03-22T03:15:10","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=21574"},"modified":"2016-03-21T20:16:54","modified_gmt":"2016-03-22T03:16:54","slug":"austin-fires-police-officer-fatal-shooting-naked-teen","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=21574","title":{"rendered":"Austin Fires Police Officer for Fatal Shooting of Naked Teen"},"content":{"rendered":"<p><iframe loading=\"lazy\" src=\"http:\/\/launch.newsinc.com\/?type=VideoPlayer\/Single&amp;widgetId=1&amp;trackingGroup=69016&amp;siteSection=statesman_nws_loc_sty_pp&amp;videoId=30515940\" width=\"590\" height=\"332\" frameborder=\"no\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><strong><span class=\"cm-tablet-hide\"><a href=\"http:\/\/www.statesman.com\/staff\/philip-jankowski\/\">Philip Jankowski<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.statesman.com\/staff\/tony-plohetski\/\">Tony Plohetski<\/a><\/span><\/strong><\/p>\n<div class=\"cm-source-title cm-tablet-hide\"><strong>American-Statesman Staff, KVUE News<\/strong><\/div>\n<p><span style=\"font-size: 14pt;\">Austin Police Chief Art Acevedo fired a 10-year department veteran Monday in the shooting death of an unarmed, naked teen \u2014 the outcome of an internal investigation that moved <a href=\"http:\/\/www.statesman.com\/news\/news\/local\/protest-at-city-hall-condemns-austin-police-shooti\/nqNbg\/\" target=\"_blank\">at an accelerated clip<\/a> amid demands from some in the community for a speedy resolution.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Officer Geoffrey Freeman, 42, used unjustified lethal force on Feb. 8 by <a href=\"http:\/\/www.mystatesman.com\/news\/news\/crime-law\/sources-man-killed-by-austin-police-monday-was-una\/nqMLz\/\" target=\"_blank\">firing twice at 17-year-old David Joseph<\/a>, according to a nine-page disciplinary memo. Freeman also was found to have violated department policies on response to resistance, encountering people exhibiting symptoms of substance-induced delirium and neglect of duty.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cMy family is glad to hear that Officer Freeman will not hurt any other unarmed Black men,\u201d David Joseph\u2019s brother, Fally Joseph, said in a statement. \u201cWhen he took my brother away from us, he stole something no one can ever give us back. We are glad to know that the City of Austin thinks David\u2019s life mattered, and that officer Freeman will not be on the streets again.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">This is the first time in more than eight years that an Austin officer has lost his job because of a fatal shooting.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Freeman, who said he shot because he feared being overpowered by the teen, will appeal the decision to an independent arbitrator, said officials with the Combined Law Enforcement Associations of Texas. The firing concludes the internal investigation, but Travis County prosecutors are still investigating Joseph\u2019s death and plan to present the case to a grand jury for a possible indictment against Freeman in coming weeks.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cCLEAT will use the resources necessary to ensure that officer Freeman\u2019s good name is restored and that he will be back to work serving the community he\u2019s called home all of his life,\u201d said Charley Wilkison, executive director of CLEAT.<\/span><\/p>\n<div class=\"cm-inline cm-inline-medleyphoto cm-inline\">\n<figure><a class=\"img_9109740\" title=\"Click to View Larger\" href=\"http:\/\/www.statesman.com\/news\/news\/crime-law\/austin-police-fires-officer-who-fatally-shot-naked\/nqp93\/#9109740\" data-asset_id=\"9109740\"><img loading=\"lazy\" decoding=\"async\" class=\"dtm-event--nongalleryphoto\" title=\"Austin police fire officer who fatally shot naked teen David Joseph\" src=\"http:\/\/media.cmgdigital.com\/shared\/lt\/lt_cache\/thumbnail\/600\/img\/photos\/2016\/03\/21\/82\/f7\/Freeman.jpg\" alt=\"Austin police fire officer who fatally shot naked teen David Joseph photo\" width=\"600\" height=\"686\" data-content-type=\"medleyphoto\" \/><\/a><\/figure>\n<div class=\"cm-related-caption\">Geoffrey Freeman<\/div>\n<\/div>\n<p><span style=\"font-size: 14pt;\">The shooting near Interstate 35 and Tech Ridge Drive prompted immediate controversy, with many in the community questioning Freeman\u2019s use of deadly force on a suspect who had no ability to conceal a weapon. Groups, including the local NAACP and Black Lives Matter, demanded the investigation be completed within 30 days.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">CLEAT called Freeman\u2019s suspension a \u201crush-to-judgment firing\u201d that was unjust and politically motivated. At a news briefing Monday, Acevedo said the decision was not subject to the political whims of either activists or labor leaders.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cMy job is not to take a poll,\u201d Acevedo said. \u201cMy job is to make a call. That call has been made. It is a very tragic incident, but if we are going to stop these tragic shootings, we have to have police officers enforce their own policies.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Freeman, who is black, has said he opened fire on Joseph, who also was African-American, when the teen charged him after he responded to calls in a North Austin neighborhood about a man harassing residents.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Officials have offered no explanation for why Joseph might have been nude, but his behavior led some to question whether he might have been under the influence of a drug such as PCP that could have given him what police frequently call \u201csuperhuman strength.\u201d However, an <a href=\"http:\/\/www.statesman.com\/news\/news\/crime-law\/autopsy-released-in-david-joseph-shooting-finds-dr\/nqn3q\/\" target=\"_blank\">autopsy released late last week<\/a> showed he had Xanax and marijuana in his system.<\/span><\/p>\n<div class=\"cm-inline cm-inline-medleygallery cm-inline cm-outset-left\">\n<div class=\"cm-photo cm-related-photo\">\n<figure><a href=\"http:\/\/www.statesman.com\/gallery\/news\/local\/officer-who-shot-naked-teen-fired-032116\/gCZwz\/\"><img loading=\"lazy\" decoding=\"async\" title=\"Officer who shot naked teen fired, 03.21.16\" src=\"http:\/\/media.cmgdigital.com\/shared\/lt\/lt_cache\/thumbnail\/275\/img\/photos\/2016\/03\/21\/d2\/d8\/rgz_APD_firing_02.JPG\" alt=\"Officer who shot naked teen fired, 03.21.16 gallery\" width=\"275\" height=\"198\" \/><\/a><\/figure>\n<\/div>\n<p><span style=\"font-size: 14pt;\">Police union officials quickly denounced Acevedo for holding a joint news conference with community members after the shooting, saying it demonstrated he already had decided the outcome of the case before reviewing the full investigation.<\/span><\/p>\n<\/div>\n<p><span style=\"font-size: 14pt;\">The last person fired for a fatal shooting was then-Sgt. Michael Olsen in December 2007, about six months after Acevedo was hired as chief. Olsen had shot Kevin Brown outside an East Austin nightclub.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Acevedo has fired two other officers for shootings that suspects survived.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Then-officer Justin Boehm was booted from the force in 2013 for shooting at a driver during a traffic stop after he reached for his wallet. The driver wasn\u2019t struck.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">A year earlier, Acevedo fired officer Christopher Allen, who had shot a home invasion suspect as he started to drive away.<\/span><\/p>\n<p><span class=\"cm-story-dateline\" style=\"font-size: 14pt;\">Allen chased the car down the street on foot while firing 10 more shots, which forced other officers to take cover, Acevedo said.
