{"id":22371,"date":"2016-04-12T12:32:41","date_gmt":"2016-04-12T19:32:41","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=22371"},"modified":"2016-04-12T12:32:41","modified_gmt":"2016-04-12T19:32:41","slug":"74-year-old-lawyer-flew-coup-14-years-ago-convicted-tax-evasion-arrested-phoenix","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=22371","title":{"rendered":"74-Year-old Lawyer Who Flew the Coup 14 Years Ago After Being Convicted of Tax Evasion Arrested in Phoenix"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Last week, the U.S. Marshals finally caught up with 74-year-old <strong>Palle Bognaes<\/strong>, also known as Pono, after being a fugitive from justice for tax evasion for more than 14 years, federal officials announced Tuesday.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-7843 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/12\/United-States-Marshals-Service-Star-Badge.jpg\" alt=\"United-States-Marshals-Service-Star-Badge\" width=\"250\" height=\"247\" \/>The former lawyer was sentenced in 2002 to more than six years in prison for obstruction of tax laws, tax evasion and failing to file income taxes. But he didn&#8217;t report to federal prison.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Bognaes was arrested in Phoenix.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">On Jan. 28, 2002, <strong>U.S. District Judge David W. Hagen<\/strong> in Reno, Nevada sentenced Bognaes to six years and eight months in prison. \u00a0Bognaes was scheduled to report to prison in March 2002, but he didn&#8217;t show up, officials said.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The evidence at trial indicated that Bognaes, a lawyer, engaged in a scheme in which he created Unincorporated Business Organizations or UBOs for his clients.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Bognaes then instructed his clients to transfer title of their assets into the UBOs and told them that they did not have to pay personal income taxes on those assets.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Bognaes collected significant fees for his services. \u00a0Bognaes referred to these UBOs by various names, including Massachusetts Trust, Common Law Trust and Pure Trust Organizations, officials said.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Bognaes also assisted co-defendant J<strong>ose Gastanaga<\/strong> of Reno, in setting up a UBO. \u00a0Together they conspired to evade the payment of more than $2 million in taxes owed by Gastanaga.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Bognaes assisted Gastanaga by attempting to prevent the IRS from seizing two homes for nonpayment of those taxes and obstructed the IRS\u2019s sale of Gastanaga\u2019s interest in a ranch located in Paradise Valley, Nevada.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The evidence also indicated that Bognaes also created UBOs for several other clients, including doctors and chiropractors and taught his clients how to conduct their transactions through the use of nominees and by wiring funds offshore to Turks and Caicos.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">For one client, Bognaes generated fake receipts to support $67,000 of false deductions during an IRS audit.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">At the time of his arrest, Bognaes contended that his name was Sam Smith.\u00a0 However, after the FBI confirmed that he was in fact, Bognaes. He was taken to prison to begin serving \u00a0his sentence.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size:
