Arizona Independent Redistricting Commission<\/em>, the plaintiffs were taking on Arizona&#8217;s Independent Election Commission, a body created through a 2000 ballot initiative intended to make redistricting less partisan.<\/span><\/p>\n<p style=\"text-align: center;\">\u00a0<span style=\"font-size: 14pt;\">To Read the\u00a0<em>Harris v. Arizona Independent Redistricting Commission <\/em>case click here: \u00a0<a href=\"http:\/\/www.supremecourt.gov\/opinions\/15pdf\/14-232_ihdj.pdf\"><strong>U.S. Supreme Court<\/strong><\/a><\/span><\/p>\n<\/div>\n<div id=\"node-body-top\" class=\"clear-block\">\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The commission produced its first legislative maps after the 2010 census. Its work came under fire almost immediately, primarily by Republicans. At one point, then-Gov. Jan Brewer (R) attempted to impeach the commission&#8217;s chair in what was seen as a power grab. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">When that failed, in 2012, the Republican-led state legislature filed a lawsuit arguing that the ballot measure that created the commission was unconstitutional because it deprived the legislature of its redistricting power. The lawsuit went all the way to the US Supreme Court, which last June ruled 5-4 in the commission&#8217;s favor.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-22650 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-300x199.jpg\" alt=\"Entering_Arizona_on_I-10_Westbound\" width=\"300\" height=\"199\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-300x199.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-768x510.jpg 768w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-1024x680.jpg 1024w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-90x60.jpg 90w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-180x120.jpg 180w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound-95x64.jpg 95w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Entering_Arizona_on_I-10_Westbound.jpg 2048w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>In the current lawsuit, filed in 2014, the plaintiffs, all Republicans, argued that the commission diluted their voting power by packing more people into Republican districts while underpopulating Democratic ones. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">They wanted the court to mandate that all district have almost exactly equal populations; the current ones vary by 4 to 8 percent. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The commission, in turn, responded that it drew the districts in such a way as to win approval from the Justice Department, in compliance with the Voting Rights Act. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Due to Arizona&#8217;s long history of suppressing minority voting, it was one of the jurisdictions required under the Voting Rights Act to clear any changes to legislative districts with the Justice Department before implementing them. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The Supreme Court gutted this requirement in <em>Shelby County v. Holder<\/em> in 2013, but it was in place when Arizona redrew its legislative maps.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">If the <em>Harris<\/em> plaintiffs had been successful, the case could have opened the floodgates to lawsuits challenging how states around the country draw their legislative districts. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">But in an opinion written by Justice Stephen Breyer, the court ruled unanimously that Arizona&#8217;s maps were indeed designed to comply with federal law in ensuring minority representation, and that the minor population deviations were acceptable.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">It&#8217;s the second time this term the court has rejected challenges to state redistricting plans from tea party conservatives upset about the growing clout of Latino voters. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In <em>Evenwel v. Abbott<\/em>, decided earlier this month, a pair of Texas plaintiffs argued that states should create state legislative districts based on the number of eligible voters in them, as opposed to total population. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The move would have granted more power to rural, white areas that lean Republican over more populated urban areas that are home to large minority (and Democratic-leaning) populations. Earlier this month, the Supreme Court unanimously ruled against the<em>Evenwel<\/em> plaintiffs.<\/span><\/p>\n<\/div>\n<div id=\"node-body-break\" style=\"text-align: center;\">\n<div class=\"billboard extended\">\n<div class=\"advertise-top norelated\"><span style=\"font-size: 14pt;\">\u00a0As <a href=\"http:\/\/www.motherjones.com\/politics\/2015\/12\/evenwel-abbott-supreme-court-redistricting\" target=\"_blank\">with <em>Evenwel<\/em><\/a>, <em>Harris<\/em> featured an unusual cast of characters. Like Sue Evenwel, lead plaintiff <a href=\"http:\/\/www.phoenixnewtimes.com\/blogs\/wes-gullett-supporter-tea-party-wackjob-wes-harris-calls-for-president-obamas-hanging-6502077\" target=\"_blank\">Wes Harris<\/a> is a tea party activist with a history of anti-immigrant rhetoric.<\/span><\/div>\n<div class=\"advertise-top norelated\"><\/div>\n<div class=\"advertise-top norelated\"><span style=\"font-size: 14pt;\">For many years, Harris, the founder of the Original North Phoenix Tea Party, worked at <a href=\"http:\/\/www.harrisbarrelworks.com\/contact.html\" target=\"_blank\">Harris Gunworks<\/a>, a manufacturing company that specialized in producing sniper rifles, though <a href=\"http:\/\/www.courtminutes.maricopa.gov\/docs\/Criminal\/102001\/m0443738.pdf\" target=\"_blank\">he can&#8217;t own a gun himself<\/a>because of his felony conviction for aggravated assault in the mid-1990s.<\/span><\/div>\n<div class=\"advertise-top norelated\"><\/div>\n<div class=\"advertise-top norelated\"><span style=\"font-size: 14pt;\">&#8220;He&#8217;s known here as being kind of an extremist,&#8221; says Richard Romley, who was the Maricopa County attorney when his office prosecuted Harris. Harris did not respond to a request for comment.<\/span><\/div>\n<\/div>\n<\/div>\n<div id=\"node-body-bottom\">\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In 2012, Harris <a href=\"http:\/\/www.huffingtonpost.com\/2012\/07\/24\/wes-harris-arizona-tea-party_n_1697793.html\" target=\"_blank\">launched a recall petition<\/a> against Sen. John McCain (R-Ariz.), largely because he was upset that McCain had come to the defense of Huma Abedin, one of Hillary Clinton&#8217;s closest aides, who conservative conspiracy theorists have alleged is a member of the Muslim Brotherhood. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">At the time, Harris told the<em>Arizona Capital Times<\/em> that Muslims should not be able to serve in government. &#8220;Have you ever read the Quran?&#8221; he said. &#8220;I suggest you do so, because anyone that is a Muslim is a threat to this country, and that&#8217;s a fact. There is no such thing as a moderate Muslim. If they are Muslim they have to follow the Quran. That&#8217;s their religion and that\u2019s their doctrine.&#8221;<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Several of his co-plaintiffs are members of a conservative group that backed the state&#8217;s widely condemned 2010 law authorizing police officers to stop people at will and demand proof of citizenship. One plaintiff, Karen MacKean, is a field director for Americans for Prosperity, the advocacy group founded by the Koch brothers.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The legal team representing Harris and his co-plaintiffs included conservative pundit Hugh Hewitt and Mark &#8220;Thor&#8221; Hearne, a conservative lawyer who <a href=\"http:\/\/bradblog.com\/?page_id=4418\" target=\"_blank\">led the Republican crusade against voter fraud<\/a>. The financial backers of this legal effort, meanwhile, remain a mystery. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Some of the lawyers involved in the case also worked on behalf of <a href=\"http:\/\/www.motherjones.com\/mojo\/2011\/11\/secretive-gop-group-az-redistricting-fight-comes-out-shadows\" target=\"_blank\">Fair Trust,<\/a> a secretive outfit that battled Arizona&#8217;s Independent Election Commission from the start as it drew the state&#8217;s legislative districts. Fair Trust was suspected of having ties to members of the state&#8217;s Republican congressional delegation. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">&#8220;We could never find out who was paying for&#8221; the trust&#8217;s work, says Arizona lawyer Colin Campbell, who represented the commission. &#8220;I guess you could say it was dark money. We don&#8217;t know where it came from.&#8221;<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Wednesday&#8217;s definitive decision should give the commission some temporary relief from the steady stream of litigation it&#8217;s seen over the past six years. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The decision is hardly a disaster for Republicans, either. Arizona is under Republican control, and it will almost certainly remain that way as long as the current legislative map\u2014the one the court upheld on Wednesday\u2014is in effect, until 2020.
