We counted up all the student debt-related arrest warrants served by U.S. Marshals in other major cities for 2015. Here\u2019s what we found:<\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-size: 14pt;\">New York-Southern (Manhattan): 0<\/span><br \/>\n<span style=\"font-size: 14pt;\"> New York-Eastern (Brooklyn, Queens, Long Island): 0<\/span><br \/>\n<span style=\"font-size: 14pt;\"> Illinois-Northern (Chicago): 0<\/span><br \/>\n<span style=\"font-size: 14pt;\"> California-Central (Los Angeles): 0<\/span><br \/>\n<span style=\"font-size: 14pt;\"> Texas-Northern, Western, and Eastern : 0<\/span><br \/>\n<span style=\"font-size: 14pt;\"> Florida-Southern: (Miami) 0<\/span><br \/>\n<span style=\"font-size: 14pt;\"> Massachusetts (Boston: 0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Instead, all the arrests are coming out of Paul Aker\u2019s hometown, Houston, home of Texas\u2019 Southern District. And they are being almost exclusively issued by a single judge: Lynn Hughes.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Hughes, 74, was appointed to the bench by Ronald Reagan in 1985. He has earned a reputation for racial insensitivity, mocking diversity directors who wouldn\u2019t recognize that, in Hughes\u2019 view, Indians are technically Caucasians; and not understanding why a remark about fried chicken and blacks might be offensive. He has actually been admonished by his own circuit for his behavior.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">PART II<\/span><\/p>\n<div class=\"fusion-oembed fusion-youtube-oembed\" style=\"text-align: center;\"><iframe loading=\"lazy\" class=\"fusion-responsive\" src=\"http:\/\/www.youtube.com\/embed\/wQjz_4HChS8?version=3&amp;rel=0&amp;showinfo=0#038;rel=1&amp;fs=1&amp;autohide=2&amp;showsearch=0&amp;showinfo=1&amp;iv_load_policy=1&amp;wmode=transparent\" width=\"640\" height=\"390\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/div>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">How do debts taken out in the \u201880s pop up 30 years later? The U.S. Department of Education refused to get into the specific mechanics of how loans in default get rotated through their system. But they are required by law to collect them no matter how old they are. If a borrower moves addresses, and fails to notify their loan servicer, they may go years without receiving a notice that they still owe money until the Department realizes that the notices aren\u2019t going through.<\/span><\/p>\n<div class=\"speed-bump-wrapper speed-bump-freewheel_instream\" style=\"text-align: center;\">\n<div class=\"freewheel-ad\">\n<div id=\"fusion-instream3\" class=\"ad-instream\"><span id=\"instream3\" style=\"font-size: 14pt;\"><span id=\"_fw_container_instream3\"><span data-width=\"1\" data-height=\"1\"><a href=\"http:\/\/2912a.v.fwmrm.net\/ad\/l\/1?s=f054&amp;n=379215%3B379215&amp;t=1461692973843861011&amp;f=&amp;r=379215&amp;adid=13138274&amp;reid=4342632&amp;arid=0&amp;auid=&amp;cn=defaultClick&amp;et=c&amp;_cc=&amp;tpos=&amp;sr=0&amp;cr=\" target=\"_blank\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/5c94f.v.fwmrm.net\/ad\/g\/1?nw=379215&amp;asid=g2706378&amp;cana=13141794&amp;canr=4342611&amp;resp=ad&amp;et=i&amp;cn=defaultImpression&amp;pvrn=RANDOM_NUMBER&amp;cr=;;ptgt=p\" alt=\"\" width=\"1\" height=\"1\" border=\"0\" \/><\/a><\/span><\/span><\/span><\/div>\n<\/div>\n<\/div>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">At this point, the Department refers the collection case gets moved to the Justice Department, which has a roster of private collection agencies across the country to file suits in federal court to collect the debt on the government\u2019s behalf.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">But whereas in every other court district we looked, a non-payer receives an absentee default judgment, which allows a debt servicer to begin doing things like garnishing wages, Judge Hughes believes in hauling offenders directly before him into court.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Why?<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Hughes refused to go on the record with us. But we can get a sense of how he thinks about these cases from transcripts from the debt collection court hearings. Here\u2019s the one from Mozie\u2019s case. As she enters the court, her debt servicer explains to Hughes that she has already agreed to set up a payment plan, and that she just needs to fax them her details. Of note: When we visited, she did not have a fax machine.<\/span><\/p>\n<blockquote><p><span style=\"font-size: 14pt;\">HUGHES: She can just fax them to you.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">CERSONSKY: Yes, sir. We have written the fax number down for her.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">HUGHES: And he doesn\u2019t need a lot of papers, ma\u2019am. I just got through looking at it. I just got through looking at it. I am so sorry.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">HUGHES: Ma\u2019am, that\u2019s okay. When somebody tells you to come down for the second or third time, you probably ought to do it, even if you think it\u2019s your son.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Mozie emphasized to us that she never fully understood why the government was trying to contact her.<\/span><\/p><\/blockquote>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cThey had a warrant for my arrest and I asked them for what, he didn\u2019t say what it was for,\u201d she said. \u201cHe said, he\u2019ll tell you later. So I just got my clothes on, went in the closet got my clothes on and walked out the door. And by the time I got out the door, they handcuffed my legs, my ankles.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Wheeler said the same thing, and added he couldn\u2019t make his court dates because he\u2019d just had open-heart surgery.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cYou just coming over here serving me papers saying I got to show up and I just told you I had open heart surgery two or three weeks ago\u2026 so I\u2019m not a well man,\u201d he said.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Richard Hunter, the director of Houston\u2019s U.S. Marshals office, said that enforcing student loan defaults puts a strain on their resources, and were candid that Hughes seemed to stand out among judges in his handling of these cases.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cIt all comes down to the interest level of the judiciary and the Marshall\u2019s district,\u201d he said.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In some districts, federal judges \u201cwon\u2019t even entertain these things.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cHere in Houston it seems that the Federal Judiciary has a particular interest in these types of matters,\u201d Hunter said.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cI won\u2019t say it\u2019s unfortunate but, you know, it is tasking on our resources and we would rather be doing other things.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Wheeler is retired, and gets by on social security and disability.
