{"id":23177,"date":"2016-05-05T20:43:01","date_gmt":"2016-05-06T03:43:01","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=23177"},"modified":"2016-05-05T20:46:38","modified_gmt":"2016-05-06T03:46:38","slug":"jurors-doctors-guilty-illegally-certifying-medicare-patients-terminally-ill-place-hospice","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=23177","title":{"rendered":"Doctors Guilty of Illegally Certifying Medicare Patients  as Terminally ill to Place Them in Hospice Care"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>LOS ANGELES<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">A federal jury Thursday found two doctors guilty today of health care fraud charges for falsely certifying that\u00a0Medicare patients were terminally ill, and therefore qualified for hospice care, when the vast majority of them were not actually dying.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-17795 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/11\/Courtroom-federal-300x223.jpg\" alt=\"Courtroom federal\" width=\"300\" height=\"223\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/11\/Courtroom-federal-300x223.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/11\/Courtroom-federal.jpg 640w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Following a two-week trial, the doctors were found guilty of participating in a scheme related to the Covina-based California Hospice Care. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Between March 2009 and June 2013, Hospice Care submitted approximately $8.8 million in fraudulent bills to Medicare and Medi-Cal for hospice-related services, and the public health programs paid nearly $7.4 million to CHC.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The two doctors convicted by a federal jury are:<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Sri Wijegoonaratna,<\/strong> known as Dr. J., 61, of Anaheim, who was found guilty of seven counts of health care fraud; and<\/span><br \/>\n<span style=\"font-size: 14pt;\"><strong> Boyao Huang<\/strong>, 43, of Pasadena, who was found guilty of four counts of health care fraud.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>U.S.District Judge S. James Otero<\/strong>, who presided over the trial, is scheduled to sentence the two defendants on August 15, at which time each will face a statutory maximum sentence of 10 years in federal prison for each count of health care fraud.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cA number of patients admitted to California Hospice Care testified at trial, showing that they did not require end-of-life care,\u201d said U.S. Attorney Eileen M. Decker. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Adding \u201cIn fact, only a small percentage of patients later died \u2013 notwithstanding the two doctors declaring that they needed hospice care. This scheme is one of many that has victimized public health care programs and, in the end, the taxpayers who fund these important programs. We will continue to investigate these fraudulent schemes, shut down the operations and incarcerate those responsible for stealing from the system.\u201d<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">Four other defendants who were named in a federal grand jury indictment in September 2014 have pleaded guilty to health care fraud charges. They are pending sentencing (except for one defendant who has been accepted into a diversion program). <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Those other defendants include a Placentia woman who purchased Hospice Care in 2007 and operated the facility after being charged and incarcerated in another health care fraud scheme. <strong>Priscilla Villabroza<\/strong>, 70, previously pleaded guilty in December to one count of health care fraud and is scheduled to be sentenced by Judge Otero on June 20.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">As part of the Hospice Care fraud scheme, Villabroza and her daughter \u2013 who was the nominal owner while Villabroza was in custody \u2013 paid patient recruiters known as \u201cmarketers\u201d or \u201ccappers\u201d to bring in Medicare and Medi-Cal beneficiaries. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Hospice Care nurses performed \u201cassessments\u201d to determine whether the beneficiaries were terminally ill and, regardless of the outcome, Wijegoonaratna and Huang certified that the beneficiaries were terminally ill \u2013 even though the vast majority of them were not dying. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Hospice Care personnel altered medical records in response to Medicare audits to make the beneficiaries appear sicker.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The evidence at trial showed that Wijegoonaratna also recruited patients into the scheme and received tens of thousands of dollars in kickbacks. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cNot only did defendant Wijegoonaratna refer beneficiaries to (Hospice Care) in exchange for illegal kickbacks, but he also created fraudulent diagnoses and falsely certified that the referred beneficiaries were terminally ill, even though the overwhelming majority of (Hospice Care) beneficiaries were not terminally ill, so that (Hospice Care) could qualify for reimbursement from Medicare,\u201d prosecutors wrote in court documents filed in relation to the trial. The California Medical <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Board has revoked Wijegoonaratna\u2019s medical license.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">By the time the scheme was shut down in June 2013, Medicare and Medi-Cal paid millions of dollars for medically unnecessary hospice-related
