{"id":23404,"date":"2016-05-15T14:08:06","date_gmt":"2016-05-15T21:08:06","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=23404"},"modified":"2016-05-15T14:08:06","modified_gmt":"2016-05-15T21:08:06","slug":"irvine-engineer-indicted-stealing-trade-secrets-two-medical-device-businesses-traveling-china-secrets","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=23404","title":{"rendered":"Engineer Indicted for Stealing Trade Secrets from Two Medical Device Businesses Then Traveling to China to Start Medical Business"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>SANTA ANA, CALIF.<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-16066 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/09\/courtroom-300x181.jpg\" alt=\"courtroom\" width=\"300\" height=\"181\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/09\/courtroom-300x181.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/09\/courtroom.jpg 700w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>A federal grand jury indicted an Irvine engineer for allegedly stealing and possessing trade secrets belonging to two former employers, both of which develop and manufacture medical devices used to treat cardiac and vascular ailments, officials announced Friday.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Wenfeng Lu,<\/strong> 43, of Irvine, was named in a 12-count superseding indictment returned by a grand jury on Wednesday.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The indictment alleges that Lu stole the confidential and proprietary trade secrets from two different medical device companies with research facilities in Irvine, where Lu worked from January 2009 until he was arrested in 2012.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">During this time, Lu travelled to the People\u2019s Republic of China \u00a0multiple times \u2013 sometimes soon after allegedly downloading trade secrets from an employer\u2019s computer and emailing information to his personal email account. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Lu was arrested as he prepared to board a plane to China in November 2012, according to court documents. Lu appeared \u201cto be in the process of setting up a company with other individuals in (China) to manufacture medical devices,\u201d an FBI agent wrote in an affidavit previously filed in this case.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cIntellectual property theft poses a grave threat to businesses and the employees who depend on those businesses for their livelihoods,\u201d said <strong>U.S. Eileen M. Decker.<\/strong> \u201cMoreover, when the stolen material is destined for foreign entities seeking to compete with American businesses, as it was in this case, IP theft also threatens the security of our nation. This is one of the reasons that my Office now prosecutes IP crimes out of a National Security Division.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Lu was initially indicted in this case in December 2012. That indictment included allegations related only to one of the companies\u2019 trade secrets. The new indictment incorporates the allegations related to four trade secrets owned by the other.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Each of the 12 felony counts alleging the theft and possession of trade secrets carries a sentence of up to 10 years in federal prison and a fine of up to $5 million.<\/span><\/p>\n<p style=\"text-align: center;\"><span
