{"id":23973,"date":"2016-06-03T18:56:20","date_gmt":"2016-06-04T01:56:20","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=23973"},"modified":"2016-06-03T19:31:08","modified_gmt":"2016-06-04T02:31:08","slug":"three-including-chiropractor-plead-guilty-scamming-southern-california-hospitals-600-million","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=23973","title":{"rendered":"Three, including Chiropractor, Plead Guilty to Scamming Workers Compensation Insurances Out of $600 Million"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 18pt;\"><strong>Santa Ana, California<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Three defendants, including a chiropractor, plead guilty Friday to being involved in a fraudulent claims scam that resulted in $600 million in losses to Southern California hospitals, according to officials.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The federal government said this was a long-running health care fraud scheme.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-16417 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/10\/Veterans-Fraud-300x172.png\" alt=\"Veterans Fraud\" width=\"300\" height=\"172\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/10\/Veterans-Fraud-300x172.png 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/10\/Veterans-Fraud.png 480w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>It illegally referred thousands of patients for spinal surgeries and generated $600 million in fraudulent billings over an eight-year period, according to authorities.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">From 2005 through 2013, Pacific Hospital billed insurers more than $580 million for spinal surgeries related to over 4,400 patients.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"> The three new defendants join six others who were previously charged in relation to the government\u2019s ongoing investigation into kickbacks for patient referrals and fraudulent bills for spinal surgeries performed at Pacific Hospital in Long Beach, according to officials.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"> The scheme involved tens of millions of dollars in illegal kickbacks to dozens of doctors, chiropractors and others. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Thousands of patients were referred to Pacific Hospital where they underwent spinal surgeries that led to more than $580 million in fraudulent bills being submitted during the last eight years of the scheme alone. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-17707 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/11\/workers-compensation-form-300x284-300x284.jpg\" alt=\"workers-compensation-form-300x284\" width=\"300\" height=\"284\" \/>Many of the fraudulent claims were paid by the California worker\u2019s compensation system and the federal government through the Federal Workers\u2019 Compensation System, according to officials.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The documents in the two unsealed cases became publicly available this week.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 18.6667px; line-height: 28px;\"><strong>These are the facts and circumstances surrounding this case:<\/strong><br \/>\n<\/span><br \/>\n<span style=\"font-size: 14pt;\"> Michael R. Drobot, 44, of Newport Beach, the son of Pacific Hospital owner Michael D. Drobot (Drobot Senior), plead guilty on March 4 to conspiracy and illegal kickback charges.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"> Drobot Junior is scheduled to be sentenced on Nov. 18.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Chiropractor Michael E. Barri, 48, of San Clemente, who owned and operated the Santa Ana companies Tri-Star Medical Group and Jojaso Management Company, plead guilty on March 11 to a conspiracy count and admitted that he received illegal kickbacks for referrals to Pacific Hospital from 2009 through October 2013. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">During a nine-month period that ended in 2013, Barri admitted receiving $158,555 in illegal kickbacks after referring a dozen patients to Pacific Hospital, where they had back surgeries. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">As a result of his referrals, Pacific Hospital billed insurance carriers approximately $3.9 million for spinal surgeries. Barri is scheduled to be sentenced in January.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-9884 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/03\/Medical-Logo-300x230.jpg\" alt=\"Medical Logo\" width=\"300\" height=\"230\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/03\/Medical-Logo-300x230.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/03\/Medical-Logo-45x35.jpg 45w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/03\/Medical-Logo.jpg 560w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Linda Martin, 66, of Clovis, California, who was a marketer for Pacific Hospital who recruited medical professionals and others to refer patients with promises of kickbacks, plead guilty to a conspiracy charge on May 27. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">She is scheduled to be sentenced on August 19.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">These three defendants join six others \u2013 including Drobot Senior \u2013 who have also pleaded guilty. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">All nine defendants have agreed to cooperate with the government\u2019s ongoing investigation \u2013 dubbed \u201cOperation Spinal Cap\u201d \u2013 into the kickback scheme, which involved dozens of surgeons, orthopedic specialists, chiropractors, marketers and other medical professionals.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6172 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading-300x228.jpg\" alt=\"FBI Insider Trading\" width=\"300\" height=\"228\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading-300x228.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading-45x35.jpg 45w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading.jpg 500w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>\u201cThe guilty pleas announced today are the latest step in holding accountable the individuals who co-opted doctors and other specialized healthcare workers to carry out multiple kickback conspiracies that abused the state and federal healthcare systems for more than a decade,\u201d said <strong>Deirdre Fike, the Assistant Director in Charge of the FBI&#8217;s Los Angeles Field Office.<\/strong> \u201cThe continuing results of Operation Spinal Cap are based on a tremendous effort by investigators and prosecutors handling this case, which is among the largest healthcare fraud schemes to be perpetrated in the state of California.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">As described in court documents, Drobot Senior \u2013 who was the owner and\/or CEO of Pacific Hospital of Long Beach until late 2013 and who pleaded guilty in April 2014 \u2013 ran a 15-year-long scheme.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">He and others submitted hundreds of millions of dollars in bills to workers\u2019 compensation insurers and the U.S. Department of Labor for spinal surgeries and other procedures performed on patients who had been referred by dozens of doctors, chiropractors and others who were paid illegal kickbacks.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">As part of the scheme, members of the conspiracy typically paid a kickback of $15,000 for each lumbar fusion surgery and $10,000 for each cervical fusion surgery. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Some of the patients lived hundreds of miles away from Pacific Hospital, and closer to other qualified medical facilities. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The patients were not informed that medical professionals had been offered kickbacks to induce them to refer the surgeries to Pacific Hospital. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">During 2005 through 2013, insurers paid the hospital more than $226 million for the surgeries performed as a result of illegal kickbacks.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Those involved in the scheme concealed the kickback payments by entering into bogus contracts to provide a \u201ccover story\u201d for the doctors, chiropractors and others who received illegal payments. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">For example, a number of doctors entered into agreements with a company owned by Drobot Senior, Pacific Specialty Physician Management, under which the doctors received as much as $100,000 per month from Physician Management in return for the right to purchase their medical practices \u2013 an option that was never exercised. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In other cases, Pacific Hospital entered into contracts with doctors under which the doctors were to help the hospital collect on its surgery bills to insurance companies. However, the hospital\u2019s own collection staff, rather than the doctors, actually performed the collections work. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Several doctors entered into lease agreements under which Physician Management or Pacific Hospital paid rent for the use of office space, but rarely used the space. And other doctors had agreements to provide consulting services to Drobot\u2019s companies, but did not actually provide the services<img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-6328 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/10\/FBI-Logo-300x225.jpg\" alt=\"FBI Logo\" width=\"300\" height=\"225\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/10\/FBI-Logo-300x225.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/10\/FBI-Logo-45x35.jpg 45w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/10\/FBI-Logo.jpg 534w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Still others, including marketers who introduced doctors to Pacific Hospital, had additional agreements with Drobot\u2019s companies.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Two other Drobot companies \u2013 California Pharmacy Management and its successor, Industrial Pharmacy Management \u2014 were also important players in the scheme. Both companies set up and managed what were essentially mini-pharmacies within doctors\u2019 offices. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Pharmacy Management and Industrial Pharmacy Management bought and dispensed medication that the doctors prescribed to their patients, and these businesses received a portion of the money reimbursed by insurance companies for the medications. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Drobot Senior, along with others at Pharmacy Management and Industrial Pharmacy Management, often agreed to increase the doctors\u2019 shares of the insurance claims in return for those doctors\u2019 referral of patients to Pacific Hospital. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In many cases, for doctors who made such referrals, the conspirators \u201cadvanced\u201d payments from Pharmacy Management and Industrial Pharmacy Management before the companies had collected any money for the medications or even prescribed them, and often simply wrote off these payments as losses when collections fell short. Drobot <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Junior was involved in these companies for over a decade, first as the manager of Pharmacy Management, and then as co-owner and manager of Industrial Pharmacy Management.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In his plea agreement, Drobot Junior admitted participating in the kickback scheme, primarily through his operation of Pharmacy Management and Industrial Pharmacy Management.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">As far back as 2005, Drobot Junior began personally soliciting doctors and chiropractors to enter into contracts with Pharmacy Managementand specifically discussed kickback arrangements, which were finalized by his father. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Drobot Junior later acted a liaison when disputes arose concerning the payment of kickbacks to medical professionals or when those kickback recipients did not refer as many patients as expected.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Drobot Junior also admitted that he induced doctors who had contracted with Pharmachy Management or Industrial Pharmacy Management to also use products and services by companies he was affiliated with, including Medi-Lab Corporation. In return for referrals to Medi-Lab, Drobot Junior received monthly payments, some of which he used to make kickback payments to the doctors.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">\u201cThese unscrupulous defendants thought they had figured out a clever scheme to line their pockets in their bilking of the insurance system. Federal and state worker\u2019s compensation programs were not designed as a slush fund for the greedy,\u201d stated IRS Criminal Investigation Acting Special Agent in Charge Anthony J. Orlando. \u201cLaw enforcement is serious about investigating these crimes and holding accountable those who defraud government health care programs and deprive patients of their right to honest services.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">When he is sentenced, Drobot Junior is facing up to \u00a0will face a statutory maximum penalty of 10 years in federal prison.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Barri and Martin each face potential prison sentences of five years as a result of their guilty pleas.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Last year, the U.S. Attorney\u2019s Office announced charges against five other defendants, including two doctors involved in the Pacific Hospital kickback scheme, and a similar scheme involving Tri-City Regional Medical Center in Hawaiian
