Times Reporters Veronica Rocha and Richard Winton<\/p>\n<p>Posted July 7, 2016<\/p>\n<p>Cellphone video showing Fresno police officers shooting an unarmed 19-year-old man lying on the ground at a gas station has sparked protests and prompted the <a title=\"FBI\" href=\"http:\/\/www.latimes.com\/topic\/crime-law-justice\/fbi-ORGOV000008-topic.html\">FBI<\/a> to launch an investigation.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-20216 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/02\/los_angeles_times_logo-300x168.jpg\" alt=\"los_angeles_times_logo\" width=\"300\" height=\"168\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/02\/los_angeles_times_logo-300x168.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/02\/los_angeles_times_logo.jpg 318w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>The shooting, which occurred last month but generated debate this week after the video was made public, is the latest in a series of police use-of-force incidents caught on tape.<\/p>\n<p>The video shows Dylan Noble lying on the ground on June 25 as two officers with their guns drawn stand feet away from him. As officers yell\u00a0\u201cKeep your hands up\u201d and other commands, one shot is fired. Seconds later, a third officer approaches the pair, and another shot rings out. At one point during the video, Noble can be seen raising his arm and saying, \u201cI\u2019ve been shot.\u201d<\/p>\n<p>The witness video does not show the moments just before the fatal shooting. Two shots already had been fired at Noble before the recording began.<\/p>\n<p>Police Chief Jerry Dyer told The Times on Thursday that\u00a0Noble twice raised his shirt with his left hand and used his right hand to reach under his shirt into his waistband. The officers, he said, feared for their lives.<\/p>\n<p>Officers warned Noble not to reach into his waistband\u00a0because they believed he was trying to retrieve a firearm, Dyer said.<\/p>\n<p>That\u2019s when an officer fired two shots with his handgun. Those shots, he said, are not depicted in the witness video. The officer then fired another shot. A second officer delivered the fourth and final shot, one round from a shotgun.<\/p>\n<aside class=\"trb_embed\" data-content-id=\"87792925\" data-content-size=\"small\" data-content-type=\"story\" data-content-slug=\"la-na-minneapolis-shooting-20160706-snap\" data-content-subtype=\"story\" data-role=\"socialshare_item imgsize_ratiosizecontainer \" data-state=\"\">\n<div class=\"trb_embed_media\">\n<figure class=\"trb_embed_imageContainer_figure\" data-role=\"imgsize_item\"><img decoding=\"async\" class=\"trb_embed_imageContainer_img alignleft\" title=\"Minnesota governor calls police shooting 'racism,' condemns officers\" src=\"http:\/\/www.trbimg.com\/img-577e88e4\/turbine\/la-na-minneapolis-shooting-20160706-snap\/350\/350x197\" alt=\"Minnesota governor calls police shooting 'racism,' condemns officers\" data-baseurl=\"http:\/\/www.trbimg.com\/img-577e88e4\/turbine\/la-na-minneapolis-shooting-20160706-snap\" data-c-nd=\"2048x1152\" data-ratio=\"16x9\" data-width=\"350\" data-height=\"200\" \/><\/figure>\n<div class=\"trb_embed_related\" data-role=\"lightbox_metadata\"><a class=\"trb_embed_media_link\" href=\"http:\/\/www.latimes.com\/nation\/la-na-minneapolis-shooting-20160706-snap-story.html\"><span class=\"trb_embed_related_title\">Minnesota governor calls police shooting &#8216;racism,&#8217; condemns officers<\/span><\/a><\/div>\n<\/div>\n<\/aside>\n<p>The video, Dyer said, doesn\u2019t tell the whole story of the shooting, which lasted about 2 minutes and 20 seconds.<\/p>\n<p>It was <a href=\"http:\/\/www.fresnobee.com\/news\/local\/crime\/article88070287.html\" target=\"_blank\">originally posted<\/a>Wednesday by the Fresno Bee.<\/p>\n<p>The officers\u2019 body cameras\u00a0will show exactly\u00a0what happened, since\u00a0they were standing 12 to 15 feet away, he said. The department will review the officers\u2019 actions to determine why they fired at Noble while he was on the ground\u00a0and if there were other options, he said. Officers have to make\u00a0split-second decisions, Dyer\u00a0noted.<\/p>\n<p>\u201cThere is going to be questions,\u201d he said.\u00a0\u00a0\u201cIt\u2019s an unfortunate tragedy that occurred in this city.\u201d<\/p>\n<p>The FBI and the U.S. attorney general\u2019s office\u00a0have\u00a0agreed to investigate the shooting and will have access to all evidence, Dyer said. The chief said he didn\u2019t\u00a0want the public to think the police department isn\u2019t\u00a0\u201cfair and objective\u201d in its handling of the investigation and that FBI oversight\u00a0would provide more transparency.<\/p>\n<p>\u201cAnytime an unarmed individual is shot, especially when their life is taken, there is a tendency for the\u00a0public to rush to judgment and come up with their own conclusions,\u201d Dyer\u00a0said.<\/p>\n<p>The body camera videos, he said, would be released once the district attorney\u2019s office has concluded its investigation. Noble\u2019s family will be allowed to view the videos before they are publicly released, Dyer added.<\/p>\n<p>According to the police department, officers responded to\u00a0a report of a\u00a0man walking with a rifle about 3:20 p.m. and observed a black pickup speeding as they searched the area. They tried to stop the truck, but it\u00a0continued traveling for half a\u00a0mile. The truck eventually pulled into a Chevron gas station, police said.<\/p>\n<p>The shooting has\u00a0<a href=\"http:\/\/www.latimes.com\/local\/lanow\/la-me-ln-unarmed-teen-shot-fresno-20160628-snap-htmlstory.html\" target=\"_blank\">sparked an online petition<\/a>\u00a0demanding that the Fresno Police Department release body camera footage of the incident. The shooting comes amid national outrage over the number of shootings by police involving\u00a0black men. In this case, Noble was white.<\/p>\n<p>Lt. Burke Farrah said\u00a0Noble refused to show his hands and tried to conceal one hand behind his back, then in his waistband. Noble, he said, got out of his truck.<\/p>\n<p>Officers repeatedly ordered Noble to show his hands and get on the ground. That\u2019s when Noble turned toward the officers with one hand still behind his back, telling them that \u201che hated his life,\u201d Farrah said. Police said Noble advanced toward officers, who then fired four shots. Farrah told The Times that\u00a0Noble did not have a weapon.<\/p>\n<p>Noble was taken to an area hospital and died during surgery.<\/p>\n<p>A\u00a0large vigil held days after the shooting drew a crowd of officers, who blocked the road for\u00a0safety, police said.<\/p>\n<p>Fresno residents and friends and\u00a0family of Noble carried a large Confederate flag as they confronted police, while others posted signs at a memorial that said \u201cJustice for Dylan,\u201d and\u00a0\u201cWhite Lives Matter.\u201d<\/p>\n<p>Videos of the gathering\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=tZXr3qWJ7ow\">posted online<\/a>\u00a0show dozens of motorcycles\u00a0and trucks participating in a lively sideshow. Drivers revved their engines and raced down a strip of road as they were cheered by onlookers.<\/p>\n<p>Dylan Noble\u2019s\u00a0father, Darren Noble, said in a statement that his son did not have emotional or mental problems and that any suggestion he wanted to die is false.<\/p>\n<p>The officers\u00a0involved in the shooting have been placed on administrative leave. Dyer declined to release the officers\u2019 names because he said\u00a0they have been receiving threats on social media. One officer has 20 years\u2019 experience with the department, and the other officer has worked in law enforcement for 17 years, Dyer said.<\/p>\n<p>The Fresno County district attorney\u2019s office has conducted interviews, collected evidence\u00a0and attended Noble\u2019s autopsy, said\u00a0Assistant\u00a0Dist. Atty.\u00a0Steve Wright. Prosecutors are waiting for the results of toxicology tests, which could take six weeks, before they review the case. A complete\u00a0investigation will\u00a0take at\u00a0least two months, Wright said.<\/p>\n<p>At least one use-of-force expert said\u00a0the chief\u2019s\u00a0statement that the shooting sequence lasted more than 2 minutes was odd.<\/p>\n<p>\u201cThat would be highly unusual. It\u2019s usually no more than\u00a0five to 20 seconds between the\u00a0first and last shot,\u201d said\u00a0Charles &#8220;Sid&#8221; Heal, a former Los Angeles\u00a0County sheriff&#8217;s commander.<\/p>\n<\/div>\n<div class=\"trb_ar_page\" data-role=\"pagination_page\" data-content-page=\"2\">\n<p>In cases where lethal force\u00a0was used,\u00a0\u201ceach and every shot must be justified as protecting the public or officers,\u201d Heal said.<\/p>\n<p>Deadly force could be deemed\u00a0justified if the officers feared for their lives because Noble made repeated furtive movements, refused to show his hands and refused to\u00a0follow commands, Heal said.<\/p>\n<p>Once Noble was on the ground after the first shots, officers would have had to reassess the threat, Heal said.<\/p>\n<p>The officers will need to explain the\u00a0last two shots seen in the video, the expert said.<\/p>\n<p>\u201cWhy didn\u2019t officers move in after the third shot and restrain him? Fourteen seconds is a long time to wait,\u201d Heal said. \u201cSometimes we get criticized for handcuffing dead people. But this is why we move in and restrain people.\u201d<\/p>\n<p>Ed Obayashi, another use-of-force expert who consults with county governments throughout California, said that even though the video fails to capture the entire shooting sequence, it does\u00a0does raise questions about\u00a0whether the\u00a0officers perceived the same threat.<\/p>\n<p>\u201cWe hear a third shot on the video and apparently that officer perceived a threat and then 14 to 16 seconds later there is a discharge of a shotgun at the individual on the ground,\u201d Obayashi said.<\/p>\n<p>\u201cAt that time, four or five officers have a direct field of vision of the man on the ground.
