{"id":25519,"date":"2016-07-24T22:07:08","date_gmt":"2016-07-25T05:07:08","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=25519"},"modified":"2016-07-25T10:37:17","modified_gmt":"2016-07-25T17:37:17","slug":"just-saying-miranda-rights-48-years-55-supreme-court-decisions-later-trumponomics-political-liars","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=25519","title":{"rendered":"Just Saying:   Miranda Rights, Trumponomics and Political Liars"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>BY RAUL HERNANDEZ<\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>NOTEBOOKVENTURA@GMAIL.COM<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">A playbook for how cops can legally tap dance around giving a suspect his Miranda rights and still not violate his constitutional rights was recently spelled out in a law enforcement magazine by a prosecutor.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">It was interesting reading to say the least, eye-opening.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-21027 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/03\/Police-Magazine-300x80.png\" alt=\"Police Magazine\" width=\"300\" height=\"80\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/03\/Police-Magazine-300x80.png 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/03\/Police-Magazine.png 732w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>First, the FBI reported that before cops were required to read suspect their Miranda rights, police officers cleared 63 percent of violent crimes. After the U.S. Supreme Court ruled that suspects must be told they had a right to remain silent, the average plummeted to 45 percent, according to Police \u2014 The Law Enforcement Magazine.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Police magazine noted that\u00a0given the numbers of reported crimes and this known reduction in clearance capability, we can reliably say that Miranda has resulted in the inability to clear a quarter-million homicides, 1 million rapes, 5 million robberies, and 9 million aggravated assaults.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-25540 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/07\/Miranda-Warning-300x176.jpg\" alt=\"Miranda Warning\" width=\"300\" height=\"176\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/07\/Miranda-Warning-300x176.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/07\/Miranda-Warning.jpg 400w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>But in the 48 years since Miranda was decided, the Supreme Court tweaked its ruling in 55 decisions to reduce the impact of their landmark decision.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The article in Police Magazine does an excellent job on explaining how cops are still getting convictions.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">It was published earlier this year by\u00a0<strong>Devallis Rutledge<\/strong> is a former police officer and veteran prosecutor who currently serves as special counsel to the Los Angeles County district attorney.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-25521 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/07\/Investigative-Constitutional-Law-230x300.jpg\" alt=\"Investigative Constitutional Law\" width=\"230\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/07\/Investigative-Constitutional-Law-230x300.jpg 230w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/07\/Investigative-Constitutional-Law.jpg 288w\" sizes=\"auto, (max-width: 230px) 100vw, 230px\" \/>Rutledge is the author of 12 books, including &#8220;Investigative Constitutional Law: Principles for Searches, Seizures, Interrogation and Identification.&#8221; \u00a0The book comes with a big price tag, $85.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Voluntary Stationhouse Interrogations<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">If you can safely delay arresting a suspect or subjecting him to custodial restraints, you can delay triggering Miranda. If your suspect is not a flight or safety risk, consider inviting him or her to the station to talk, as officers did in two of the Supreme Court&#8217;s impact-reducing cases, Rutledge wrote.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In <strong><a href=\"http:\/\/caselaw.findlaw.com\/us-supreme-court\/429\/492.html\">Oregon v. Mathiason<\/a><a href=\"http:\/\/caselaw.findlaw.com\/us-supreme-court\/429\/492.html\">,<\/a><\/strong> a burglary suspect agreed to come to the station voluntarily. He was told he was not under arrest, and was treated accordingly. Without warnings, he confessed to the crime.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The Supreme Court held that Miranda did not apply, because Mathiason was not in custody during the questioning. \u00a0Said the court, &#8220;Police officers are not required to administer Miranda warnings to everyone they question. Nor is the requirement of warnings to be imposed simply because the questioning takes place in the station house, or because the questioned person is one whom the police suspect,&#8221; Rutledge stated.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The Supreme Court repeated this ruling in<strong> <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/463\/1121\/\">California v. Beheler<\/a><\/strong>, a case in which officers asked a murder suspect to come to the station, told him that he was not under arrest, and made it clear he was free to leave whenever he wanted. The court held that Miranda did not apply, and Beheler&#8217;s confession was admissible against him.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">When taking advantage of these two rulings, it&#8217;s advisable to tell the suspect at the outset, &#8220;You&#8217;re not under arrest. You&#8217;re free to leave at any time.&#8221; After he confesses to the crime, you&#8217;re free to change your mind and arrest him.(Stansbury v. California)<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Undercover Questioning<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><strong><span style=\"font-size: 14pt;\">Here is what Rutledge wrote about what cops are able to do:<\/span><\/strong><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">&#8220;If a voluntary station house interrogation is not a practical option and the circumstances require you to take the suspect into custody, consider delaying overt interrogation while trying covert questioning by an undercover officer, posing as a fellow prisoner.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In <strong><a href=\"http:\/\/caselaw.findlaw.com\/us-supreme-court\/496\/292.html\">Illinois v. Perkins<\/a><\/strong>, officers placed their arrestee into a cell where an undercover officer, wearing jailhouse clothes, engaged him in conversation. The suspect&#8217;s unwarned statements were admissible, because there is no compulsion to speak to a perceived fellow prisoner.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The Supreme Court said this: &#8220;An undercover officer posing as a fellow inmate need not give Miranda warnings to an incarcerated suspect before asking questions that may elicit an incriminating response. Miranda does not forbid strategic deception by taking advantage of a suspect&#8217;s misplaced trust.&#8221;<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Particularly in the more serious cases where suspects are more likely to invoke,Perkins often provides a legitimate means to reduce Miranda&#8217;s impact, according to Rutledge. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Prepare the cell in advance, with audio and video recording if possible, and brief your undercover officer as to the details he needs to cover. This technique produces admissible statements in homicides and other serious cases more often than you might think.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Strategic Deception at Arrest<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The Supreme Court has held that you can lawfully arrest for any crime as to which you have probable cause in <strong><a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/03-710.ZS.html\">Devenpeck v. Alford.<\/a><\/strong><\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">This means you do not have to tell a suspect he is under arrest on the most serious charge you could support, but may initially arrest him for something less serious, giving him less incentive to invoke Miranda. If he then waives, you&#8217;re free to question him about any crime you suspect he may have committed.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In <strong><a href=\"http:\/\/caselaw.findlaw.com\/us-supreme-court\/479\/564.html\">Colorado v. Spring<\/a><\/strong>, ATF agents arrested a man for a firearms violation, even though he was also suspected of murder. Given Miranda warnings, he waived and talked about the firearms offense. Agents then asked if he had ever shot anyone, and he admitted that he &#8220;shot a guy once.&#8221; This admission was used to convict him of murder.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Rejecting Spring&#8217;s argument that the agents should have warned him of all the crimes he was going to be questioned about, the Supreme Court said the following: &#8220;A suspect&#8217;s awareness of all the crimes about which he may be questioned is not relevant to determining the validity of his decision to waive the Fifth Amendment privilege.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Mere silence by law enforcement officers as to the subject matter of an interrogation is not &#8216;trickery&#8217; sufficient to invalidate a suspect&#8217;s waiver of Miranda rights.&#8221;<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">The Spring decision can reduce the impact of Miranda on your chances of getting a waiver and a statement, if you simply arrest your suspect for a less serious crime, take a waiver, and gradually expand your interrogation into the facts of the more serious crime. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Following interrogation, you&#8217;re free to book on the more serious charges.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Implied Waivers<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Twice, the Supreme Court has held that there is no requirement to ask the suspect if he wants to waive his rights.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">In<strong> <a href=\"http:\/\/caselaw.findlaw.com\/us-supreme-court\/441\/369.html\">North Carolina v. Butler<\/a>,<\/strong> the court said that &#8220;an explicit statement of waiver is not invariably necessary,&#8221; and that Miranda waivers may also be implied from the fact that a warned suspect answers questions or makes a statement.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong><a href=\"https:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1470.pdf\">Berghuis v. Thompkins<\/a><\/strong> held that if a suspect is fully warned and acknowledges that he understands the rights, it isn&#8217;t necessary for officers to ask him if he wants to talk.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Said the court, &#8220;If the State establishes that a Miranda warning was given and that it was understood by the accused, an accused&#8217;s uncoerced statement establishes an implied waiver. After giving a Miranda warning [including acknowledgment of understanding], police may interrogate a suspect who has neither invoked nor waived Miranda rights,&#8221; according to\u00a0Rutledge.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Needlessly asking a warned suspect whether he wants to talk gives him an opportunity to invoke by simply saying, &#8220;No.&#8221; <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">But if you dispense with this unnecessary question and simply start talking to him after the warning and acknowledgment, he is more likely to answer some engaging, non-threatening question, thereby establishing his implied waiver and allowing interrogation to continue, according to Rutledge.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>State Variations<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Although states can create greater restrictions on interrogations than Miranda imposes, they cannot do so on the basis of Miranda.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Instead, they must rely on state statutes or constitutions. &#8220;A state court can neither add to nor subtract from the mandates of the United States Constitution,&#8221; upon which Miranda is based. Butler)<\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Trumponomics<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Republican presidential nominee Donald Trump told Chuck Todd of Meet the Press Sunday that he would consider pulling the United States out of the World Trade Organization should he end up winning the election.<\/span><\/p>\n<div class=\"_tN _VCh _WCh _IWg mod\" style=\"text-align: center;\" data-md=\"32\"><span style=\"font-size: 14pt;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-21181 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/03\/Trump-Make-America-Great-Again-237x300.jpg\" alt=\"Trump Make America Great Again\" width=\"237\" height=\"300\" \/>\u00a0The <b>World Trade Organization<\/b> (<b>WTO<\/b>) is a global international <b>organization <\/b>that\u00a0 deals with the rules of <b>trade<\/b> between nations. <b>WTO<\/b> agreements, negotiated and signed by the bulk of the <b>world&#8217;s trading\u00a0<\/b>nations.<\/span><\/div>\n<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\">Also Trump repeated to the New York Times that the U.S.<a href=\"http:\/\/www.nytimes.com\/2016\/07\/21\/us\/politics\/donald-trump-issues.html?_r=0\" target=\"_blank\" data-beacon=\"{&quot;p&quot;:{&quot;mnid&quot;:&quot;entry_text&quot;,&quot;lnid&quot;:&quot;citation&quot;,&quot;mpid&quot;:1}}\">\u00a0would not come to the aid of NATO allies<\/a> if they hadn\u2019t fully paid their dues to the organization.<\/span><\/p>\n<div class=\"_3-8m\" style=\"text-align: center;\">\n<div class=\"_30o4\"><span class=\"_5mdd\" style=\"font-size: 14pt;\">If the GOP&#8217;s financial Wiz is elected, pull out of 401ks, sell all stock and don&#8217;t plan an early retirement, the economy is going to tank and the jobless rate is going to soar.<\/span><\/div>\n<div class=\"_30o4\"><span class=\"_5mdd\" style=\"font-size: 14pt;\">Trumponomics is on a collision course with economics 101, according to Fiscal Times.<\/span><\/div>\n<\/div>\n<div class=\"_30o4\" style=\"text-align: center;\">\n<p><span style=\"font-size: 14pt;\"><strong><a href=\"http:\/\/www.thefiscaltimes.com\/2016\/05\/17\/Experts-Weigh-Donald-Trump-s-Tax-Plan-and-Find-It-Wanting\"><i>The Fiscal Times<\/i><\/a><\/strong>\u00a0in May asked a panel of distinguished experts in tax and fiscal policy to review the Trump proposal. They were uniformly unimpressed.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">\u201cThis is pie-in-the-sky nonsense,\u201d said William G. Gale, the Arjay and Frances Miller Chair in Federal Economic Policy at the Brookings institution and the co-director of the Tax Policy Center. Gale also served on the Council of Economic Advisers under President George H. W. Bush.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\">In a<strong><a href=\"https:\/\/www.washingtonpost.com\/opinions\/donald-trump-is-a-unique-threat-to-american-democracy\/2016\/07\/22\/a6d823cc-4f4f-11e6-aa14-e0c1087f7583_story.html\"> Washington Post editorial last week<\/a><\/strong>, the newspaper wrote: \u00a0&#8220;In a dangerous world, Mr.\u00a0Trump speaks blithely of <a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2016\/07\/21\/trump-undercut-key-foreign-policy-commitments-just-before-pence-pledged-to-uphold-them\/\">abandoning NATO<\/a>, encouraging more nations to <a href=\"https:\/\/www.washingtonpost.com\/news\/monkey-cage\/wp\/2016\/04\/06\/should-more-countries-have-nuclear-weapons-donald-trump-thinks-so\/\">obtain nuclear weapons<\/a> and\u00a0<a href=\"https:\/\/www.washingtonpost.com\/politics\/inside-trumps-financial-ties-to-russia-and-his-unusual-flattery-of-vladimir-putin\/2016\/06\/17\/dbdcaac8-31a6-11e6-8ff7-7b6c1998b7a0_story.html\">cozying up<\/a> to dictators who in fact wish the United States nothing but harm. For eight years, Republicans have criticized President Obama for \u201capologizing\u201d for America and for weakening alliances. Now they put forward a candidate who mimics the vilest propaganda of authoritarian adversaries about how terrible the United States is and how unfit it is to lecture others. He has made clear that he would drop allies without a second thought.
