It was the overnight shift at the Montgomery County jail in Dayton, Ohio, and Joseph Guglielmo banged on the door of cell 114 again and again.<\/span><\/article>\n
<\/article>\n
The 57-year-old veteran with post-traumatic stress disorder had been arrested at a homeless shelter earlier that night in January 2015. He\u2019d struggled with a security guard at the shelter and against the officers who had come to arrest him. <\/span><\/article>\n
<\/article>\n
Now he was demanding some unspecified medicine and annoying his guards.<\/span>So, his civil rights complaint says, they decided to \u201cteach him a lesson.\u201d<\/span><\/p>\n
\"washingtonpost\"\u00a0Six guards gathered in front of cell 114, Guglielmo\u2019s attorney said. They massed around the door, blocking the view of a hallway camera.<\/span><\/div>\n<\/article>\n

What happened next is the subject of a federal civil rights complaint from Guglielmo, who served as an operating room technician in the Air Force.<\/span><\/p>\n

\u201cThree of them went in and beat the crap out of him,\u201d\u00a0his attorney, Jennifer L. Branch, told The Washington Post.<\/span><\/p>\n

One guard, Matthew Snyder, \u201cbeat Guglielmo repeatedly and threw him against the concrete wall,\u201d the complaint says. Snyder reportedly \u201cdelivered closed-fist strikes to Mr. Guglielmo\u2019s head, eye <\/span>area and abdomen\u201d while other guards watched.<\/span><\/p>\n

Afterward, a nurse gave Guglielmo ice packs, and guards moved him to a holding cell where he could be closely observed.<\/span><\/p>\n

But his condition worsened.<\/span><\/p>\n

Just after midnight, Snyder noticed that although Guglielmo appeared asleep, his feet were twitching, the complaint\u00a0says. Fifteen minutes later, when guards tried to reposition Guglielmo\u2019s unconscious body to better see him through a window, the 57-year-old was unresponsive.<\/span><\/p>\n

He was taken to a hospital, where he lay in a coma for four weeks. When he woke up, he was no longer able to walk, his attorney said.<\/span><\/p>\n

The court documents say he\u00a0is confined to a wheelchair. He lives in a nursing home and rehabilitation center, and receives round-the-clock care, his attorney said.<\/span><\/p>\n

On Wednesday, Branch questioned why officers had to go into her client\u2019s cell at all. He was alone and not harming himself or anyone else. And she said the sheriff\u2019s office violated its own policies in dealing with unruly prisoners. An extraction team is supposed to remove problem prisoners from their cells and place them in restraint chairs.\u00a0And that process is supposed to be videotaped.<\/span><\/p>\n

It\u2019s the latest in a stream of excessive force claims for the Montgomery County jail. Sheriff Phil Plummer declined to comment for this story. Montgomery County commissioners, who are also named in the complaint, didn\u2019t return messages.<\/span><\/p>\n

In connection his own criminal case, Guglielmo pleaded guilty to aggravated menacing and was sentenced to 180 days in jail, according to the Associated Press<\/a>. He was given credit for two days served, and the remainder of the sentence was suspended.<\/span><\/p>\n

Guglielmo\u2019s complaint mentions several other excessive-force allegations that have put the 900-bed jail under the microscope. A military officer was \u201cviciously beaten and kicked<\/a>\u201d at the jail in 2006. In 2012, a man died after he was pinned to the ground while officers put their weight on his back until he stopped breathing.<\/span><\/p>\n

The most recent case involved Amber Swink, who was blasted with pepper spray.<\/span><\/p>\n

Swink had kicked and spat on the arresting officer and punched a cell window, according to The Post\u2019s Peter Holley<\/a>. She was pepper-sprayed, then secured in a restraint chair and placed in an isolation room.<\/span><\/p>\n

Then Sgt. Judith Sealey went into the restraint room and pepper-sprayed her.<\/span><\/p>\n

Pepper-spraying an inmate was one of several protocol violations that occurred that night, according to Holley\u2019s report. Sealey never filled out a use-of-force report, and the sheriff\u2019s office never burned the video onto a disk.<\/span><\/p>\n

Swink\u2019s complaint also alleges that \u201cseveral private meetings were held\u201d within the department to discuss how officials might conceal Sealey\u2019s actions. Department officials eventually decided to destroy electronic data and reports to prevent litigation, the complaint states.<\/span><\/p>\n

Guglielmo\u2019s legal action comes as law enforcement agencies are under intense scrutiny for using force against suspects.<\/span><\/p>\n

Last year, 963 people were shot and killed by police, including 241 who had some form of mental illness. The year before, 991 had been shot dead by police, 254 of whom had signs of mental illness.<\/span><\/p>\n
