(Photo courtesy of Andrew Noel)<\/figcaption><\/figure>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The evidence presented at trial established that the defendant and other officers responded to a 911 call alleging that an unidentified black male with dreadlocks and a white t-shirt had been involved in a street fight and was carrying a gun. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Upon their arrival on the scene, officers found no evidence of any street fight, but they noticed one man who matched that general description, sitting in his car talking on a cellphone. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">One of the responding officers, along with his police K-9, approached the man\u2019s car and, without identifying himself as a police officer, yelled at the man to get out. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The man, later identified as Frank Baker, got out of the car, as the officer yelled commands and the police K-9 barked loudly at him. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"><a href=\"https:\/\/cjnotebook.com\/two-men-involved-one-largest-smuggling-rings-synthetic-narcotics-arrested-today\/department-of-justice\/\" rel=\"attachment wp-att-3918\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3918 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice-300x300.png\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice-300x300.png 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice-150x150.png 150w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice.png 350w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>Seven seconds later, the officer released the K-9, which took Baker to the ground and began mauling his leg. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">While Baker was on the ground, screaming in pain, the defendant arrived and kicked Baker three times in the ribs.\u00a0 <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The defendant\u2019s kicks broke seven of Baker\u2019s ribs and caused both of his lungs to collapse, putting him in critical condition. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Officers found no gun at the scene and no evidence that Baker, a 52-year-old grandfather who lived in the neighborhood, had been involved in any fight.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"><a href=\"https:\/\/cjnotebook.com\/sheriffs-deputy-charged-with-shooting-an-unarmed-person-and-lying-about-it\/jail-hallway\/\" rel=\"attachment wp-att-37897\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-37897\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2019\/08\/Jail-Hallway.jpg\" alt=\"\" width=\"259\" height=\"194\" \/><\/a>Two veteran officers who witnessed the defendant\u2019s actions that night, officers Joseph Dick and Anthony Spencer, reported the defendant to their supervisor. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Dick and Spencer both testified at trial about the defendant\u2019s use of excessive force and about the harassment and retaliation they suffered after stepping forward to report a fellow officer. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">They and other officers also testified that after the arrest, back at the police station, the defendant boasted to several officers about the force of his kicks and about having seriously injured Baker.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cInstead of lawfully carrying out his critical public safety responsibilities, Palkowitsch abused his authority by using excessive force,\u201d said Principal Deputy Assistant Attorney General for Pamela S. Karlan of the Justice Department\u2019s Civil Rights Division. \u201cThe Justice Department will continue to vigorously prosecute officers who engage in criminal misconduct.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cLaw enforcement officers take an oath to serve and protect the public,\u201d said Special Agent in Charge of the FBI Minneapolis Field Office. \u201cWhen an officer betrays that oath and violates a person&#8217;s civil rights, that officer must be held accountable.
