Some students also said they feared that if they told adults about the racial harassment their harassers would retaliate and the harassment would get worse. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">Several said that they disliked attending school and at times missed school because of racial harassment. Students also told us in interviews that administrators and teachers targeted them for discipline. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">Students believed they were disciplined for behavior that white students also engaged in without consequence. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">Several Black students also reported feeling that some teachers, most of whom are white, were less welcoming and helpful academically to them in comparison to white reports that were not captured in the District\u2019s database \u201cEncore\u201d or other records. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">Indeed, various administrators acknowledged that they did not enter all complaints in Encore. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">Moreover, administrators admitted they did not maintain many documents, including complaints of racial harassment and other forms of discrimination. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">DOJ notified the District that it should retain all documents relevant to this investigation. 2 Despite repeated requests, the District\u2019s production of this information remains incomplete. 3 DOJ conducted two in-person and three virtual site visits. In addition, DOJ personnel traveled to Davis County, Utah to meet with and interview complainants and community members. 2 students. <\/span><\/li>\n<li><span style=\"font-size: 20px;\">Black students reported that they wanted access to student organizations similar to those offered to other students that would serve as a forum for discussing and addressing common experiences but their schools had not approved requests for such clubs.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 20px;\"><strong>To read the entire letter click here:\u00a0<\/strong> <a href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/1443856\/download\">DOJ<\/a><\/span><\/p>\n<p><span style=\"font-size: 20px; text-align: center;\">The Department of Justice opened its investigation in July 2019 under Title IV of the Civil Rights Act of 1964.<\/span><\/p>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The investigation\u00a0<a class=\"doj-analytics-processed\" href=\"https:\/\/www.justice.gov\/opa\/press-release\/file\/1443856\/download\">revealed<\/a>\u00a0persistent failures to respond to reports of race-based harassment of Black and Asian-American students by district staff and other students. <\/span><\/p>\n<figure id=\"attachment_48319\" aria-describedby=\"caption-attachment-48319\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-48319 size-medium\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/10\/umv5tzsinkhyc7mq7v8o-300x225.webp\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/10\/umv5tzsinkhyc7mq7v8o-300x225.webp 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/10\/umv5tzsinkhyc7mq7v8o.webp 512w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-48319\" class=\"wp-caption-text\">Davis School District<\/figcaption><\/figure>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The department concluded that for years, Davis\u2019s ineffective response left students vulnerable to continued harassment and that students believed the district condoned the behavior. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The department also found that Davis disciplined Black students more harshly than their white peers for similar behavior and that Davis denied Black students the ability to form student groups while supporting similar requests by other students.\u00a0 <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Black and Asian-American students are each roughly 1 percent of the approximately 73,000 students enrolled in the district.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-43413 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/07\/l4ygusg0fxs-200x300.jpg\" alt=\"woman in gold dress holding sword figurine\" width=\"200\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/07\/l4ygusg0fxs-200x300.jpg 200w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/07\/l4ygusg0fxs-683x1024.jpg 683w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/07\/l4ygusg0fxs-768x1152.jpg 768w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/07\/l4ygusg0fxs-300x450.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/07\/l4ygusg0fxs.jpg 800w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/>\u201cPervasive racial harassment and other forms of racial discrimination in public schools violate the Constitution\u2019s most basic promise of equal protection,\u201d said Assistant Attorney General Kristen Clarke of the Civil Rights Division. \u201cThis agreement will help generate the institutional change necessary to keep Black and Asian-American students safe. We look forward to Davis demonstrating to its students and school community that it will no longer tolerate racial discrimination in its schools.\u201d\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cThe Justice Department thanks the many parents and students who came forward and shared their experiences and the Davis School District for its cooperation with our investigation,\u201d said Acting United States Attorney Andrea Martinez for the District of Utah. \u201cAs the federal partners who work and live in this community, we are hopeful that this agreement is the start of a new chapter in which Black and Asian-American students will attend Davis schools without fear.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Under the agreement, Davis will retain a consultant to review and revise anti-discrimination policies and procedures and support the district as it undertakes significant institutional reforms.\u00a0 Among other steps, Davis will:<\/span><\/p>\n<ul style=\"text-align: center;\">\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">create a new department to handle complaints of race discrimination;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">train staff on how to identify, investigate, and respond to complaints of racial harassment and discriminatory discipline practices;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">inform students and parents of how to report harassment and discrimination;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">create a centralized, electronic reporting system to track and manage complaints and Davis\u2019s response to complaints;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">implement student, staff, and parent training and education on identifying and preventing race discrimination, including discriminatory harassment;<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">analyze and review discipline data and amend policies to ensure non-discriminatory enforcement of discipline policies; and<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px;\">develop a districtwide procedure to assess requests for
