Ten cops arrive and all of them leave with their tails between their legs.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">This guy \u2014 Long Island Audit \u2014 does a fantastic job of holding city officials and police officers accountable.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\"><strong>CONSTITUTIONAL AND OTHER RIGHTS\u00a0<\/strong><\/span><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">People assume that those enforcing the law know the law. That couldn&#8217;t be further from the truth.\u00a0 After working for more than three decades in four different <img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-39137 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-300x300.jpg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-300x300.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-150x150.jpg 150w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-270x270.jpg 270w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-192x192.jpg 192w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-180x180.jpg 180w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag-32x32.jpg 32w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2018\/11\/cropped-first_amendment_flag.jpg 512w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>newspapers, I had first-hand knowledge of how ignorant many cops, judges, and other lawyers are of the law. They don&#8217;t have a clue about how the law or the U.S. Constitution works.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">I am not a lawyer but I make an effort to educate myself on legal matters and issues that pertain to the work I did, especially when I covered state and federal courts for 18 years<\/span>.<\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">For example, several years ago, I was covering a trial during jury selection. The courtroom was nearly empty with the exception of a prosecutor, two defense attorneys, a bailiff and a court reporter.\u00a0 Prospective jurors were in the hallway waiting to come into the courtroom.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">I sat in the middle row inside the courtroom.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">The bailff comes up and says, &#8220;hey, Raul, you are going to have to leave because we need all the seats, and I because we have jury panels coming into the court.&#8221;<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">&#8220;What? This is a trial and jury selection is part of an open trial. I have a right to be here and so do other members of the public.&#8221;<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">&#8220;I&#8217;m sorry but I need all the seats for the jury pool.&#8221;<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1537 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/LADYJUSTICE.jpg\" alt=\"\" width=\"274\" height=\"240\" \/>The prosecutor, the defense lawyers, and the court staff were watching.\u00a0 Nobody said a word, and I was not happy.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">&#8220;This is bullshit.\u00a0 Jury selection is part of a trial,&#8221; I said.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">The bailiff had second thoughts, &#8220;well I can let you stay. I guess. But that&#8217;s it.&#8221;<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">&#8220;That&#8217;s okay, I&#8217;ll be back.&#8221;<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">I left and returned the<\/span> <span style=\"font-size: 20px;\">next day with a copy of the U.S. Supreme Court case \u2014 Presley v. Georgia (2010)<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">Basically, in that case, a family member of an alleged drug suspect was kicked out of court because the judge need the space for jury selection. No members of the public or media, in that case, were allowed inside the courtroom while they were picking jurors.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">The U.S. Supreme Court ordered a new trial for the defendant, Eric Presley<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">I showed the 2010 Georgia case to the bailiff and asked that he give it to the judge.\u00a0 A few weeks later, I bumped into now-retired Ventura County Judge James Cloninger. Judge Cloninger said the Ventura County judges are now going to allow space in the courtroom for the media and the public to sit during jury selection in a trial.\u00a0 There are very rare exceptions to closing a courtroom that can be applied during a trial.<\/span><\/div>\n<div dir=\"auto\"><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">These are the people who went to law school, some who became judges and were ignorant of the right to a free trial under the U.S. Constitution.<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">People assume that those who enforce the law, interpret the law, and prosecute cases know the law that apply to the right to a public trial \u2014 nope, many of them do not:<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0<\/span><\/div>\n<div dir=\"auto\" style=\"text-align: center;\"><strong><span style=\"font-size: 20px;\">Presley v. Georgoa (2010)<\/span><\/strong><\/div>\n<div dir=\"auto\">\n<p><span style=\"font-size: 20px;\">After a jury trial in the Superior Court of DeKalb County, Georgia, petitioner Eric Presley was convicted of a cocaine trafficking offense. The conviction was affirmed by the Supreme Court of Georgia. 285 Ga. 270, 674 S.E.2d 909 (2009). <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Presley seeks certiorari, claiming his Sixth and Fourteenth Amendment right to a public trial was violated when the trial court excluded the public from the\u00a0<i>voir dire<\/i>\u00a0of prospective jurors.<\/span><\/p>\n<p><span style=\"font-size: 20px;\"> The Supreme Court of Georgia&#8217;s affirmance contravened this Court&#8217;s clear precedents. Certiorari and petitioner&#8217;s motion for leave to proceed\u00a0<i>in forma pauperis<\/i>\u00a0are now granted, and the judgment is reversed.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">Before selecting a jury in Presley&#8217;s trial, the trial court noticed a lone courtroom observer.\u00a0<i>Id.,<\/i>\u00a0at 270-271, 674 S.E.2d, at 910. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The court explained that prospective jurors were about to enter and instructed the man that he was not allowed in the courtroom and had to leave that floor of the courthouse entirely.\u00a0<i>Id.,<\/i>\u00a0at 271, 674 S.E.2d, at 910. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The court then questioned the man and learned he was Presley&#8217;s uncle.\u00a0<i>Ibid.<\/i>\u00a0The court reiterated its instruction:<\/span><\/p>\n<blockquote><p><span style=\"font-size: 20px;\">&#8220;`Well, you still can&#8217;t sit out in the audience with the jurors. You know, most of the afternoon actually we&#8217;re going to be picking a jury. And we may have a couple of pre-trial matters, so you&#8217;re welcome to come in after we &#8230; complete selecting the jury this afternoon. But, otherwise, you would have to leave the sixth floor, because jurors will be all out in the hallway in a few moments. That applies to everybody who&#8217;s got a case.'&#8221;\u00a0<i>Ibid.<\/i><\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 20px;\">Presley&#8217;s counsel objected to &#8220;`the exclusion of the public from the courtroom,'&#8221; but the court explained, &#8220;`[t]here just isn&#8217;t space for them to sit in the audience.'&#8221;\u00a0<i>Ibid.<\/i>\u00a0<\/span><\/p>\n<p><span style=\"font-size: 20px;\">When Presley&#8217;s counsel requested &#8220;`some accommodation,'&#8221; the court explained its ruling further:<\/span><\/p>\n<blockquote><p><span style=\"font-size: 20px;\">&#8220;`Well, the uncle can certainly come back in once the trial starts. There&#8217;s no, really no need for the uncle to be present during jury selection&#8230;. [W]e have 42 jurors coming up. Each of those rows will be occupied by jurors. And his uncle cannot sit and intermingle with members of the jury panel. But, when the trial starts, the opening statements and other matters, he can certainly come back into the courtroom.'&#8221;\u00a0<i>Ibid.<\/i><\/span><\/p><\/blockquote>\n<p><span style=\"font-size: 20px;\">After Presley was convicted, he moved for a new trial based on the exclusion of the public from the juror\u00a0<i>voir dire.<\/i>\u00a0<\/span><\/p>\n<p><span style=\"font-size: 20px;\">At a hearing on the motion, Presley presented evidence showing that 14 prospective jurors could have fit in the jury box and the remaining 28 could have fit entirely on one side of the courtroom, leaving adequate room for the public. App. to Pet. for Cert. E-37, E-41. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The trial court denied the motion, commenting that it preferred to seat jurors throughout the entirety of the courtroom, and &#8220;it&#8217;s up to the individual judge to decide &#8230; what&#8217;s comfortable.&#8221;\u00a0<i>Id.,<\/i>\u00a0at E-38. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The court continued: &#8220;It&#8217;s totally up to my discretion whether or not I want family members in the courtroom to intermingle with the jurors and sit directly behind the jurors where they might overhear some inadvertent comment or conversation.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-size: 20px;\"><i>Id.,<\/i>\u00a0at E-42 to E-43. On appeal, the Court of Appeals of Georgia agreed, finding &#8220;[t]here was no abuse of discretion here, when the trial court explained the need to exclude spectators at the voir dire stage of the proceedings and when members of the\u00a0<a class=\"gsl_pagenum\" href=\"https:\/\/scholar.google.com\/scholar_case?case=8725375503504966505&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1#p723\">723<\/a><a id=\"p723\" class=\"gsl_pagenum2\" href=\"https:\/\/scholar.google.com\/scholar_case?case=8725375503504966505&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1#p723\">*723<\/a>\u00a0public were invited to return afterward.&#8221; 290 Ga.App. 99, 100-101, 658 S.E.2d 773, 775 (2008).<\/span><\/p>\n<p><span style=\"font-size: 20px;\">The Supreme Court of Georgia granted certiorari and affirmed, with two justices dissenting.<br \/>\n<\/span><\/p>\n<p><strong><span style=\"font-size: 20px;\">After finding &#8220;the trial court certainly had an overriding interest in ensuring that potential jurors heard no inherently prejudicial remarks from observers during voir dire,&#8221; the Supreme Court of Georgia rejected Presley&#8217;s argument that the trial court was required to consider alternatives to closing the courtroom. 285 Ga., at 272, 273, 674 S.E.2d, at 911.<\/span><\/strong><\/p>\n<p><span style=\"font-size: 20px;\"> It noted that &#8220;the United States Supreme Court [has] not provide[d] clear guidance regarding whether a court must, sua sponte, advance its own alternatives to [closure],&#8221; and the court ruled that &#8220;Presley was obliged to present the court with any alternatives that he wished the court to consider.&#8221;\u00a0<i>Id.,<\/i>\u00a0at 273, 674 S.E.2d, at 911, 912. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">When no alternatives are offered, it concluded, &#8220;there is no abuse of discretion in the court&#8217;s failure to sua sponte advance its own alternatives.&#8221;\u00a0<i>Id.,<\/i>\u00a0at 274, 674 S.E.2d, at 912.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">This Court&#8217;s rulings with respect to the public trial right rest upon two different provisions of the Bill of Rights, both applicable to the States via the Due Process Clause of the Fourteenth Amendment. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The Sixth Amendment directs, in relevant part, that &#8220;[i]n all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial &#8230;.&#8221; <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The Court in\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=2004315850814366936&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1\"><i>In re Oliver,<\/i>\u00a0333 U.S. 257, 273, 68 S.Ct. 499, 92 L.Ed. 682 (1948),<\/a>\u00a0made it clear that this right extends to the States. The Sixth Amendment right, as the quoted language makes explicit, is the right of the accused.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">The Court has further held that the public trial right extends beyond the accused and can be invoked under the First Amendment.\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=7177156780794430986&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1\"><i>Press-Enterprise Co. v. Superior Court of Cal., Riverside Cty.,<\/i>\u00a0464 U.S. 501, 104 S.Ct. 819, 78 L.Ed.2d 629 (1984)<\/a>\u00a0<i>(Press-Enterprise I).<\/i>\u00a0This requirement, too, is binding on the States.\u00a0<i>Ibid.<\/i><\/span><\/p>\n<p><span style=\"font-size: 20px;\">The case now before the Court is brought under the Sixth Amendment, for it is the accused who invoked his right to a public trial. An initial question is whether the right to a public trial in criminal cases extends to the jury selection phase of trial, and in particular the\u00a0<i>voir dire<\/i>\u00a0of prospective jurors. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">In the First Amendment context that question was answered in\u00a0<i>Press-Enterprise I. Id.,<\/i>\u00a0at 510,\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=7177156780794430986&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1\">104 S.Ct. 819<\/a>. The Court there held that the\u00a0<i>voir dire<\/i>\u00a0of prospective jurors must be open to the public under the First Amendment. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Later in the same Term as\u00a0<i>Press-Enterprise I,<\/i>\u00a0the Court considered a Sixth Amendment case concerning whether the public trial right extends to a pretrial hearing on a motion to suppress certain evidence.\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=11178690261128284829&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1\"><i>Waller v. Georgia,<\/i>\u00a0467 U.S. 39, 104 S.Ct. 2210, 81 L.Ed.2d 31 (1984)<\/a>. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The\u00a0<i>Waller<\/i>\u00a0Court relied heavily upon\u00a0<i>Press-Enterprise I<\/i>\u00a0in finding that the Sixth Amendment right to a public trial extends beyond the actual proof at trial. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">It ruled that the pretrial suppression hearing must be open to the public because &#8220;there can be little doubt that the explicit Sixth Amendment right of the accused is no less protective of a public trial than the implicit First Amendment right of the press and public.&#8221;\u00a0<a href=\"https:\/\/scholar.google.com\/scholar_case?case=11178690261128284829&amp;q=presley+v.+georgia&amp;hl=en&amp;as_sdt=2006&amp;as_vis=1\">467 U.S., at 46, 104 S.Ct. 2210<\/a><\/span><\/p>\n<p><span style=\"font-size: 20px;\"><strong>For More Information on Presley v.
