Alexander Kueng were found to have deprived Floyd of his constitutional right, according to officials.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">No sentencing date has been set. The three are facing up to life in prison for the death.<\/span><\/p>\n<\/div>\n<\/div>\n<p><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/XaDet9JkFhY\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<\/div>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p><span style=\"font-size: 20px;\">Each of the officers willfully failed to intervene to stop former MPD Officer Derek Chauvin\u2019s use of unreasonable force, resulting in bodily injury to and the death of Floyd.\u00a0<\/span><\/p>\n<figure id=\"attachment_49002\" aria-describedby=\"caption-attachment-49002\" style=\"width: 330px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-49002 \" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/02\/images-15.jpg\" alt=\"\" width=\"330\" height=\"247\" \/><figcaption id=\"caption-attachment-49002\" class=\"wp-caption-text\">Derek Chauvin<\/figcaption><\/figure>\n<p><span style=\"font-size: 20px;\">Thao, Kueng, and Former MPD Officer Thomas Lane also was found to have deprived Floyd of his constitutional right to be free from a police officer\u2019s deliberate indifference to his serious medical needs when they saw him restrained in police custody in clear need of medical care and willfully failed to aid him<\/span><\/p>\n<p><span style=\"font-size: 20px;\">This resulted in bodily injury to and the death of Mr. Floyd.\u00a0<\/span><\/p>\n<p><span style=\"font-size: 20px;\">The convictions announced today are separate from and in addition to any and all charges the State of Minnesota has brought against these former officers related to the death of Floyd. <\/span><\/p>\n<figure id=\"attachment_49003\" aria-describedby=\"caption-attachment-49003\" style=\"width: 275px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-49003 size-full\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/02\/images-16.jpg\" alt=\"\" width=\"275\" height=\"183\" \/><figcaption id=\"caption-attachment-49003\" class=\"wp-caption-text\">Derek Chauvin with his knee on George Floyd&#8217;s neck. Three other officers who stood around and didn&#8217;t do anything to stop the murder of Floyd by Chauvin.<\/figcaption><\/figure>\n<p><span style=\"font-size: 20px;\">The federal charges addressed civil rights offenses that criminalize violations of the U.S. Constitution.<\/span><\/p>\n<p><span style=\"font-size: 20px;\"><strong>\u201c<\/strong>Today\u2019s verdict recognizes that two police officers violated the Constitution by failing to intervene to stop another officer from killing George Floyd, and three officers violated the Constitution by failing to provide aid to Mr. Floyd in time to prevent his death,\u201d said Attorney General Merrick B. Garland. \u201cThe Justice Department will continue to seek accountability for law enforcement officers whose actions, or failure to act, violate their constitutional duty to protect the civil rights of our citizens. George Floyd should be alive today.\u201d<\/span><\/p>\n<p><span style=\"font-size: 20px;\">Co-defendant Derek Chauvin <a href=\"https:\/\/www.justice.gov\/opa\/pr\/former-minneapolis-police-officer-derek-chauvin-pleads-guilty-federal-court-depriving-george\">previously entered<\/a>\u00a0a guilty plea in connection with the federal case. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Chauvin pleaded guilty to willfully depriving Floyd of his constitutional rights while Chauvin was serving as an MPD officer.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-22946 alignright\" style=\"font-size: 20px;\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Courtroom-300x169.png\" alt=\"\" width=\"300\" height=\"169\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Courtroom-300x169.png 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2016\/04\/Courtroom.png 650w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><span style=\"font-size: 20px;\">Chauvin also acknowledged that his conduct resulted in death and that he acted in callous and wanton disregard of the consequences to Floyd\u2019s life. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">In addition, Chauvin was tried in state court and convicted of second-degree murder. In 2021, Chauvin was sentenced in state court to 22.5 years in prison.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">Evidence presented at the federal trial for defendants Thao, Kueng and Lane established that on May 25, 2020, then-MPD Officer Chauvin held his knees on Floyd\u2019s neck and back as Floyd lay on the ground, handcuffed and unresisting. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">As soon as Floyd was on the ground, Chauvin placed his knee on the back of Floyd\u2019s neck, while Kueng placed his knee on Floyd\u2019s lower body. Chauvin would not remove his knee for the next nine minutes and 29 seconds, and Kueng maintained his position for the next eight minutes and 11 seconds. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Throughout this period, Floyd pleaded with officers 25 times to let him breathe.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">As Floyd lost consciousness and a pulse, Chauvin and Kueng maintained their positions on his body. Even as Floyd ceased movement and stopped speaking, and even as Lane noted that Floyd was \u201cpassing out\u201d and Kueng said he could not find a pulse, none of the CPR-certified defendants did anything to stop Chauvin from keeping his knee on Floyd\u2019s neck or to render the medical aid that they were trained and required to provide. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Even as EMTs arrived and checked Floyd\u2019s pupils and pulse, Chauvin did not move his knee and the other officers on scene did not render aid to Mr. Floyd.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">Firefighters and EMTs unsuccessfully attempted to revive Floyd on the way to the hospital, where he was pronounced dead. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">The county medical examiner ruled Floyd\u2019s death was a homicide due to cardiopulmonary arrest complicating law enforcement subdual, restraint and neck compression.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">After the incident, an MPD supervisor and, later, an MPD lieutenant, spoke with Lane and Kueng. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">On both occasions, Lane and Kueng both omitted that Chauvin had knelt on Mr. Floyd\u2019s neck, that Floyd had been restrained on his stomach for nine and a half minutes, that Floyd had lost consciousness, and that officers had not been able to find a pulse. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Additionally, Kueng told the supervisor that Floyd did not stop moving until after an ambulance arrived on the scene, which he admitted at trial was false. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">At trial, the MPD lieutenant testified that, after watching a video taken by a bystander, he realized that what he was told and what was on the video was \u201ctotally different.\u201d <\/span><\/p>\n<p><span style=\"font-size: 20px;\">He further testified that if an MPD officer observed another officer using too much force or doing something illegal, the officer has a duty to intervene to stop it, regardless of rank or seniority. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Testimony offered at trial established that this duty to intervene is enshrined in MPD policy and is a component of the police department\u2019s training program.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">Evidence presented at trial also showed that MPD officers were required to complete emergency medical responder (EMR) training prior to entering the police academy, which includes CPR training. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Further, MPD policy requires officers to determine if a subject is injured after a use of force and to render medical aid as soon as reasonably practical and requires officers assisting a person experiencing a medical crisis to provide first aid while awaiting EMS.<\/span><\/p>\n<p><span style=\"font-size: 20px;\">The jury found that the defendants disregarded this training and willfully violated Floyd\u2019s constitutional rights. Kueng and Thao failed to intervene to stop Chauvin\u2019s use of unlawful force and all three defendants failed to provide aid to Floyd as he suffered a medical emergency at the hands of a fellow police officer. \u00a0<\/span><\/p>\n<p><span style=\"font-size: 20px;\">The jury found that the defendants disregarded this training and willfully violated Floyd\u2019s constitutional rights. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Kueng and Thao failed to intervene to stop Chauvin\u2019s use of unlawful force and all three defendants failed to provide aid to Mr. Floyd as he
