Gutierrez sentenced Eduardo Moreno, 46, of San Pedro.<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\"> The judge also ordered Moreno to pay $755,880 in restitution.<\/span><br \/>\n<iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/njCVQ2XmhFc\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Moreno plead guilty in December 2021 to one count of committing a terrorist attack and other violence against railroad carriers and mass transportation systems.<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0 \u201c[Moreno\u2019s] offense was extraordinarily serious, and he used his unique access as a licensed train conductor to derail a multi-ton train toward a government hospital ship whose purpose was to treat vulnerable patients in the midst of a global pandemic,\u201d prosecutors wrote in a sentencing memorandum.<\/span><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/Dd7gBxap_rQ\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><br \/>\n<span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 On March 31, 2020, Moreno drove a train at high speed, did not slow down near the end of the railroad track, and intentionally derailed the train off the tracks near the United States Naval Ship\u00a0<i>Mercy<\/i>\u00a0\u2013 a hospital ship then docked in the Port of Los Angeles.<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 No one was injured in the incident, and the\u00a0<i>Mercy<\/i>\u00a0was not harmed or damaged. <\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">The incident resulted in the train leaking a substantial amount \u2013 approximately 2,000 gallons \u2013 of diesel fuel, which required clean-up by fire and other hazardous materials personnel. <\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">Clean-up crews recovered approximately 400 gallons of fuel from the fuel tank and the ground adjacent to the derailment, according to court documents.<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Moreno caused $755,880 in damage because of the derailment.<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In his first interview with the Los Angeles Port Police, Moreno acknowledged that he \u201cdid it,\u201d saying that he was suspicious of the\u00a0<i>Mercy<\/i>\u00a0and believed it had an alternate purpose related to COVID-19 or a government takeover, according to an affidavit filed with a criminal complaint in this case. <\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">Moreno stated that he acted alone and had not pre-planned the attempted attack. <\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">While admitting to intentionally derailing and crashing the train, he said he knew it would bring media attention and \u201cpeople could see for themselves,\u201d referring to the\u00a0<i>Mercy<\/i>, according to the affidavit.<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 In a second interview with FBI agents, Moreno stated that \u201che did it out of the desire to \u2018wake people up,\u2019\u201d the affidavit states. \u201cMoreno stated that he thought that the\u00a0<i>Mercy<\/i>\u00a0was suspicious and did not believe \u2018the ship is what they say it\u2019s for.\u2019\u201d<\/span><\/p>\n<p class=\"yiv1201020946MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/span><span style=\"font-size: 20px;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The FBI\u2019s Joint Terrorism Task Force and the Port of Los Angeles Police investigated this
