Bailey suffered a broken jaw as a result of the assault. Evans was aware that chokeholds were banned at Madison County Detention Center and that punching and strangling Bailey out of anger was an unreasonable use of force.<\/span><\/p>\n<\/div>\n<\/div>\n<\/div>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/bjwelGNjISM\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Following the assault, Evans falsified an incident report and made false statements to the FBI. <\/span><\/p>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Specifically, Evans falsely claimed that he had ordered Bailey to turn around prior to the assault, that Bailey ignored his commands, and he deliberately omitted the fact that he had strangled Bailey.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cThe defendant is being held accountable for using excessive force to assault and strangle a man ou<\/span><span style=\"font-size: 20px;\">t of <\/span><span style=\"font-size: 20px;\">anger,\u201d said Assistant Attorney General Kristen Clarke of the Justice Department\u2019s Civil Rights Division. \u201cThe Civil Rights Division will continue to investigate and prosecute law enforcement officials who deprive individuals of their Constitutional rights.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cCorrections officers <\/span><span style=\"font-size: 20px;\">have extremely difficult jobs; however, our community demands these officers conduct themselves professionally,\u201d said Special Agent in Charge Jodi Cohen of the FBI Louisville Field Office.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u00a0Evans is facing up to 10 years in prison.
