Federal Grand Jury Convicts Doctor of Health Care Fraud Scheme Involving Ear Wax Removal"},"content":{"rendered":"<p id=\"node-title\" style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-50053 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-200x300.jpg\" alt=\"brown wooden chairs inside room\" width=\"200\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-200x300.jpg 200w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-683x1024.jpg 683w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-768x1152.jpg 768w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji.jpg 800w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/>A federal jury convicted a New York man Friday for defrauding Medicare and Medicaid by causing the submission of false and fraudulent claims for surgical procedures that were not performed, officials stated.<\/span><\/p>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">According to court documents and evidence presented at trial, Harold Bendelstein, 71, of Queens, billed Medicare and Medicaid for an incision procedure of the external ear for hundreds of patients, when in fact all he actually performed was an ear exam or ear wax removal. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Specifically, between January 2014 and February 2018, Bendelstein, an ENT doctor, billed Medicare and Medicaid approximately $585,000 and was paid approximately $191,000. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Medicare and Medicaid data demonstrated that Bendelstein was an outlier and the highest biller for this procedure in New York State.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Bendelstein was convicted of one count of health care fraud and one count of making a false claim. He is scheduled to be sentenced on Nov. 7, and faces up to 15 years in prison.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Trial Attorneys Andrew Estes and Patrick J.
