{"id":50648,"date":"2022-08-23T19:03:11","date_gmt":"2022-08-24T02:03:11","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=50648"},"modified":"2022-08-23T19:16:26","modified_gmt":"2022-08-24T02:16:26","slug":"oregon-white-supremacist-guilty-of-hate-crime-for-assaulting-black-man","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=50648","title":{"rendered":"Oregon White Supremacist Guilty of Hate Crime for Assaulting Black DJ at Bar"},"content":{"rendered":"<p id=\"node-title\" style=\"text-align: center;\"><span style=\"font-size: 24px;\">An Oregon man pleaded guilty to hate crime and false statement charges in federal court in Washington, officials stated.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Randy Smith, 42, pleaded guilty to committing a hate crime for his participation in the assault of T.S., a Black man, which occurred because of the man\u2019s actual and perceived race.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/sDX1oCSRUTM\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Smith assaulted T.S. at a bar in Lynnwood, Washington, on Dec. 8, 2018.\u00a0<\/span><\/p>\n<div class=\"field field--name-field-pr-body field--type-text-long field--label-hidden\">\n<div class=\"field__items\">\n<div class=\"field__item even\">\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">In his plea agreement, Smith admitted that, at the time of the assault, he was a member of a white supremacist support group. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-50053 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-200x300.jpg\" alt=\"brown wooden chairs inside room\" width=\"200\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-200x300.jpg 200w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-683x1024.jpg 683w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji-768x1152.jpg 768w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/06\/1yeql23dvji.jpg 800w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/>On Dec. 8, 2018, Smith entered a bar in Lynnwood, Washington, with others, including fellow support group members as well as members of a higher-level white supremacist group. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Smith wore clothing and patches indicating his group membership and gave a \u201cNazi salute\u201d as he entered the bar. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">While inside, Smith assaulted T.S, a Black man who was serving as the disc jockey at the bar, because he believed that T.S. was being disrespectful to the members of the white supremacist groups. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Smith repeatedly punched T.S., while others punched, kicked, and\/or stomped on T.S. and called T.S. racial slurs. <\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1057 size-medium alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart-300x300.jpg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart-300x300.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart-150x150.jpg 150w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart.jpg 320w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">As a result of the assault, T.S. suffered bodily injuries. Two bystanders attempted to intervene to help T.S. and stop the assault. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Both bystanders were assaulted by members of the white supremacist groups, and both sustained injuries.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">In addition to the hate crime charge, Smith pleaded guilty to making false statements to FBI agents about the circumstances surrounding the assault. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Specifically, Smith falsely claimed to the agents that he did not remember anyone calling T.S. a racial slur during the assault. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1537 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/LADYJUSTICE.jpg\" alt=\"\" width=\"274\" height=\"240\" \/>This statement was false in that Smith knew he and others called T.S. racial slurs before, during, and after the assault. Smith made this false statement to the FBI because he wanted to cover up the motive for the assault, which was the bias that he and others had against T.S.\u2019s race.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Smith will be sentenced on Nov. 18. The hate crime charge carries a maximum penalty of 10 years in prison. The false statement charge carries a maximum penalty of up to five years in prison.\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Smith was charged in an indictment that was unsealed on Dec. 18, 2020. The seven-count indictment also charged three other men, each aiding and abetting one another, with punching and kicking T.S. while making derogatory comments about his actual and perceived race. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">The indictment further charged Smith and the three other men with assaulting two men who intervened to protect T.S. during the attack, as well as with making false statements to the FBI during the course of their investigation. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Two of these three men, Jason DeSimas and Daniel Dorson, previously pleaded guilty in this matter.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Smith also pleaded guilty to unlawful possession of a firearm charge arising from conduct in Oregon in 2020. I<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">n the plea agreement, Smith admitted that he unlawfully possessed a Ruger 9mm pistol despite knowing that he had being previously convicted of a felony. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">The unlawful possession of a firearm charge carries a maximum penalty of up to 10 years in prison. This case was investigated by the FBI and prosecuted by Assistant U.S. Attorney William McLaren of the District of Oregon.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">This case was investigated by the FBI, with the support of the Snohomish County Sheriff\u2019s Office. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Trial Attorney Christine M.
