He noted that he had watched the videos of the incident and falsely deemed those uses of force \u201cjustified.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Several days later, on or about Aug. 13 and Aug. 14, 2018, the captain of MPD\u2019s patrol division tasked Krejsa with conducting a more in-depth review of the officers\u2019 uses of force during L.G.\u2019s arrest, which was separate from the typical shift sergeant review.<\/span><\/p>\n<\/div>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/jRr4QeC_8i8\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<div class=\"field__item even\">\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">In response to this request, Krejsa watched the involved-officers\u2019 body worn camera videos, which revealed what had happened during the arrest: Two officers under his supervision, Chase Winkle and Corey Posey, approached L.G. in an alley way and gave several verbal commands to L.G. \u2013 including to put his hands on his head and to get on the ground \u2013 and L.G. complied with those commands. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-51539 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/12\/download-12.jpg\" alt=\"\" width=\"225\" height=\"225\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/12\/download-12.jpg 225w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2022\/12\/download-12-150x150.jpg 150w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/>On the ground, as Posey held both of L.G.\u2019s hands behind his back, L.G. directed a verbal insult toward officers, and in response, Winkle, using his knee, dropped his bodyweight down onto L.G.\u2019s neck and head area. L.G. screamed out words to the effect of, \u201cHe crushed my whole face!\u201d and pulled his hands towards his face. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Winkle then tased L.G., as other MPD officers, including Officer Jeremy Gibson, arrived to assist. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Toward the end of the incident, officers secured one of L.G.\u2019s hands in handcuffs, lifted him up to a seated position, and Gibson delivered two forceful knee strikes directly to L.G.\u2019s face.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-1057 size-medium\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart-300x300.jpg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart-300x300.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart-150x150.jpg 150w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/Justice-Depart.jpg 320w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">After reviewing the officers\u2019 body camera videos, Krejsa knowingly authored a lengthy memorandum for MPD\u2019s official records that contained several false statements. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Specifically, Krejsa falsely implied that any force used against L.G. was justified to ensure officer safety; falsely asserted that officers used only low levels of force near the start of the incident.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Krejsa stated that the officers escalated to higher levels of force only after less force was ineffective; falsely stated that Winkle \u201ckneeled on [L.G.]\u2019s left shoulder and upper body,\u201d when in fact Krejsa knew that Winkle had used his knee to strike L.G.\u2019s head and neck area; and falsely implied that Winkle\u2019s uses of force against L.G. caused only cuts to L.G.\u2019s face, when Krejsa knew that the use of force against L.G. caused serious bodily injury to L.G. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1073 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/criminal_justice_jurisprudence-2.jpg\" alt=\"\" width=\"299\" height=\"188\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/criminal_justice_jurisprudence-2.jpg 299w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/criminal_justice_jurisprudence-2-120x76.jpg 120w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/criminal_justice_jurisprudence-2-265x168.jpg 265w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/criminal_justice_jurisprudence-2-284x180.jpg 284w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/02\/criminal_justice_jurisprudence-2-274x173.jpg 274w\" sizes=\"auto, (max-width: 299px) 100vw, 299px\" \/>As part of his plea, Krejsa admitted that he knew, when he wrote the false report, that the inaccuracies and material omissions in his report were intended to influence any potential investigation into the incident.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Krejsa was one of four MPD officers who were <a href=\"https:\/\/www.justice.gov\/usao-sdin\/pr\/muncie-police-officers-indicted-additional-charges-excessive-force-and-obstruction\">indicted<\/a>\u00a0in April 2021 in a 17-count superseding indictment for their roles in using excessive force against arrestees and\/or attempting to cover up the misconduct. A fifth Muncie police officer, Dalton Kurtz, previously entered a pre-indictment\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/muncie-indiana-police-officer-pleads-guilty-misprision-felony-concealing-crime-committed\">guilty plea<\/a>\u00a0on Aug. 4, 2021, to one count of misprision of felony for concealing and failing to report inappropriate use of force by Winkle during a separate incident.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-15368 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/09\/Courtroom.jpg\" alt=\"\" width=\"330\" height=\"299\" \/>On May 13, 2022, Gibson also\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/former-indiana-police-officer-pleads-guilty-civil-rights-offense-following-assault-arrestee\">pleaded guilty<\/a>\u00a0to civil rights and obstruction charges for assaulting a different arrestee and writing a false report about the incident. On Dec. 5, 2022, Winkle\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/former-muncie-indiana-police-officer-pleads-guilty-eleven-civil-rights-and-obstruction\">pleaded guilty<\/a>\u00a0to eleven counts of civil rights and obstruction offenses for assaulting arrestees and writing false reports about the incidents, including the arrest of L.G. The last remaining officer is scheduled to stand trial at a later date.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 24px;\">Trial Attorneys Katherine G. DeVar and Mary J. Hahn of the Civil Rights Division\u2019s Criminal Section and Assistant U.S. Attorney Peter Blackett for the Southern District of Indiana are prosecuting the
