Garland. \u201cThe court recognized that the Galveston County Commissioners Court redistricting plan deprived the county\u2019s Black and Latino voters of an equal opportunity to participate in the political process and elect a candidate of their choice. The Justice Department will continue to stand up for the right of every eligible citizen to vote and to have that vote counted.\u201d<\/p>\n<p>The court\u2019s ruling comes following a bench trial earlier this year that lasted from Aug. 7 through 18.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-40438 size-medium\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/09\/t9cxbzluvic-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/09\/t9cxbzluvic-300x200.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/09\/t9cxbzluvic-1024x683.jpg 1024w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/09\/t9cxbzluvic-768x512.jpg 768w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/09\/t9cxbzluvic-1536x1024.jpg 1536w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/09\/t9cxbzluvic-2048x1366.jpg 2048w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p>The redistricting plan at issue in the case was adopted by the county on Nov. 12, 2021, after the release of the data from the 2020 Census.<\/p>\n<p>The Justice Department filed its complaint against Galveston County in March 2022.<\/p>\n<p>\u201cThis ruling should send a clear message that all jurisdictions, whether at the state or local level, must comply with the Voting Rights Act,\u201d said Assistant Attorney General Kristen Clarke of the Justice Department\u2019s Civil Rights Division. \u201cThe Voting Rights Act stands as one of our most important civil rights laws that protects the ability of communities of color to participate in the political process and have an equal opportunity to elect candidates of choice.&#8221;<\/p>\n<p>Adding, &#8220;As the court made clear, this is not a typical redistricting case. Even though there was no need to do so, the commissioners&#8217; court eliminated Black and Latino voters\u2019 opportunity to have a voice on that body. As the district court correctly found, destroying the only district with a majority of Black and Latino residents is a blatant violation of the Voting Rights Act.\u201d<\/p>\n<p>\u201cThe right to vote is one of the fundamental rights in our democracy, a right guaranteed irrespective of race or ethnicity, said U.S. Attorney Alamdar Hamdani for the Southern District of Texas. \u201cThis decision protects the rights of Black and Latino voters in Galveston County and affords them an equal opportunity to have a voice on the Galveston County Commissioners\u2019 Court consistent with federal law.\u201d<\/p>\n<p>The court held that the county\u2019s plan prevents Black and Latino voters from electing a candidate of choice in any district.<\/p>\n<p>In particular, the court found that the county eliminated an existing district where such an opportunity had existed for decades.<\/p>\n<p>The court observed that doing so was \u201cmean-spirited\u201d and \u201cegregious,\u201d given that there was no reason to make significant changes to the district as it had previously existed.<\/p>\n<p>The court concluded that the County\u2019s elimination of that district extinguished the Black and Latino communities\u2019 voice on its commissioners&#8217; court.<\/p>\n<p>It does so even though these two groups comprise 38% of the total population in Galveston County.<\/p>\n<p>Because candidate qualifying for Galveston County\u2019s 2024 elections is fast approaching, the County has until Oct. 20 to enact a redistricting plan that contains at least one district that provides Black and Latino voters with an equal opportunity to elect a candidate of choice to the county governing body.<\/p>\n<p>If the county prefers not to submit a revised plan, the court has ordered it to implement a redistricting plan presented by the United States on or before Nov. 1.<\/p>\n<p><iframe loading=\"lazy\" title=\"US Department of Justice sues Galveston County claiming violation of Voting Rights Act\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/k9XeD7lpIu0?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Complaints about discriminatory practices may be reported to the Civil Rights Division through its internet reporting portal at\u00a0<a href=\"https:\/\/www.civilrights.justice.gov\/\" target=\"_blank\" rel=\"noopener\">www.civilrights.justice.gov<\/a>\u00a0or by calling (800) 253-3931.<\/p>\n<p>Additional information about the Civil Rights Division\u2019s work to uphold and protect the voting rights of all Americans is available on the Justice Department\u2019s website at\u00a0<a href=\"https:\/\/www.justice.gov\/crt\/voting-section\">www.justice.gov\/crt\/voting-section<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. District Court ruled Friday that the redistricting plan used by the governing body of Galveston County, Texas, known as the Commissioners Court, violates the Voting Rights Act.
