It will assess whether those activities are reasonable and non-discriminatory and respect the right to engage in speech and conduct protected by the First Amendment.<\/span><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" style=\"border: 0 none transparent;\" src=\"https:\/\/video.ibm.com\/embed\/20082839\" width=\"480\" height=\"270\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p style=\"text-align: center;\"><strong>(Justice Department Announces Investigation of the City of Lexington, Mississippi, and the Lexington Police Department)<\/strong><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">The investigation will include a comprehensive review of LPD policies, training and supervision, practices for the collection of fines and fees, and systems of accountability.\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">In this investigation, the department will assess the law enforcement practices under the First, Fourth and 14th Amendments to the U.S. Constitution, Title VI of the Civil Rights Act of 1964, and the non-discrimination provisions of the Safe Streets Act.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-54633 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/11\/download-38.jpg\" alt=\"\" width=\"412\" height=\"231\" \/>Suppose the Justice Department has reasonable cause to believe that the law enforcement officers of a state or local government have engaged in a prohibited pattern or practice. Then, the department is authorized to bring a lawsuit seeking court-ordered changes to remedy the violations, officials stated.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">\u201cNo city, no town and no law enforcement agency is too large or too small to evade our enforcement of the constitutional rights every American enjoys,\u201d said Assistant Attorney General Kristen Clarke of the Justice Department\u2019s Civil Rights Division. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">Adding, \u201cwe are opening this investigation to determine whether the Lexington Police Department engages in a pattern or practice of discriminatory policing, excessive force, or First Amendment violations. This investigation should send a clear message to small and midsize police departments that they are not exempt from the obligation to provide fair, effective, and non-discriminatory policing. We will leave no community behind, including underserved regions in the Deep South, in our quest to ensure lawful and constitutional policing in America.\u201d<\/span><\/p>\n<figure id=\"attachment_54634\" aria-describedby=\"caption-attachment-54634\" style=\"width: 324px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-54634\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/11\/download-3.png\" alt=\"\" width=\"324\" height=\"223\" \/><figcaption id=\"caption-attachment-54634\" class=\"wp-caption-text\"><span style=\"font-size: 18px;\">Lexington, Mississippi<\/span><\/figcaption><\/figure>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">Wednesday&#8217;s announcement marks the 11th pattern or practice investigation into law enforcement misconduct by the Justice Department.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">The Special Litigation Section of the Justice Department\u2019s Civil Rights Division and the U.S. Attorney\u2019s Office for the Southern District of Mississippi will jointly conduct this investigation under the Violent Crime Control and Law Enforcement Act of 1994.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">It prohibits state and local governments from engaging in a pattern or practice of conduct by law enforcement officers that deprives people of rights protected by the Constitution or federal law.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">The department has ongoing investigations into the <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-investigation-city-phoenix-and-phoenix-police-department\">Phoenix Police Department<\/a>; the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-launches-investigation-mount-vernon-police-department\">Mount Vernon (NY) Police Department<\/a>; the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-investigation-louisiana-state-police\">Louisiana State Police<\/a>; the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-investigation-new-york-city-police-department-s-special-victims\">New York City Police Department\u2019s Special Victims Division<\/a>; the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-launches-investigation-worcester-police-department\">Worcester (MA) Police Department<\/a>; the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-launches-investigation-oklahoma-s-mental-health-service-system-and\">Oklahoma City Police Department<\/a>; the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-announces-pattern-or-practice-investigation-city-memphis-and-memphis\">Memphis (TN) Police Department<\/a>; and the\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-and-us-attorneys-office-district-new-jersey-announce-investigation-city-0\">Trenton (NJ) Police Department<\/a>. The department recently completed investigations in Louisville, Kentucky, and Minneapolis, and secured agreements in principle with both jurisdictions to negotiate consent decrees to address the violations found.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif; font-size: 18px;\">\u201cPolice officers are trusted with the important duty to keep our communities safe. When police officers fail to respect constitutional rights, they violate that trust,\u201d said U.S. Attorney Todd W. Gee for the Southern District of Mississippi. \u201cOur office is committed to ensuring that everyone in Mississippi is treated fairly and lawfully by the police. Today\u2019s announcement reflects that commitment.
