Staton sentenced Johnny Paul Tourino, 69, of Dana Point. Tourino has agreed to forfeit approximately $2 million in seized funds.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The FBI, the Commerce Department\u2019s Office of Export Enforcement, and IRS Criminal Investigation investigated this matter.<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">On March 3, Tourino pleaded guilty to one count of conspiracy to violate IEEPA, which controls and restricts the export of certain goods from the United States to foreign nations and U.S. sanctions against Iran.<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-229 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2013\/12\/FBI-300x165.png\" alt=\"\" width=\"300\" height=\"165\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2013\/12\/FBI-300x165.png 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2013\/12\/FBI.png 615w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>According to court records, Tourino owned and operated Spectra Equipment Inc., a Laguna Niguel-based computer support and services company. <\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">Between September 2015 and March 2017, Tourino negotiated the sale of five business-class computer servers valued at $2.1 million and attempted to send them to Iran for use by <\/span><a rel=\"nofollow noopener noreferrer\" name=\"OLE_LINK2\"><\/a><span style=\"font-size: 20px;\">two Iranian financial institutions, Bank Mellat\u00a0and Bank Keshavarzi.\u00a0<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">In February 2017, when the manufacturer of the servers asked Tourino to identify the end-user, he falsely stated that the servers were being sold to a bank in Africa and \u201cNOT going to Iran.\u201d <\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1381 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/irs2-300x244.jpg\" alt=\"\" width=\"300\" height=\"244\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/irs2-300x244.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/irs2.jpg 443w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>Later that month, Tourino, through his lawyer, falsely represented to the manufacturer that the servers were going to Slovenia.<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">One week later, Tourino sent three checks to the manufacturer as partial payment for the servers. <\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">After learning that the Department of Treasury had blocked funds from Iran that were to be used to pay for the servers, Tourino deleted his emails, contacted the Department of Treasury, and again falsely stated that the servers were not going to Iran and were destined for Slovenia.<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">According to court documents, in August 2015, Tourino previously brokered the sale of four business-class computer servers that were ultimately sent to Bank Mellat in Iran. Regarding these servers, Judge Staton noted, \u201cThe government cannot get back the 2015 servers.\u201d <\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">These servers offered high-level encryption, allowing the users to shield information from law enforcement detection.<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cDefendant Tourino conspired to export restricted equipment to a foreign adversary illegally and took steps to conceal his activities to avoid law enforcement scrutiny,\u201d said Donald Alway, the Assistant Director in Charge of the FBI\u2019s Los Angeles Field Office. \u201cTourino\u2019s activity violated U.S. economic and trade sanctions and, in the process, potentially aided an oppressive terrorist regime and put America\u2019s long-term security interests at risk.\u201d<\/span><\/p>\n<p class=\"yiv9832775084MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px;\">Assistant U.S. Attorneys Mark Takla of the Terrorism and Export Crimes Section and Bradley Marrett of the Santa Ana Branch Office prosecuted this case.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0LOS ANGELES\u00a0 An Orange County man was sentenced Friday to 18 months in federal prison for conspiring to buy and illegally ship high-end computer servers from the U.S. to Iran in violation&#8230;<\/p>\n","protected":false},"author":1,"featured_media":54951,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[],"class_list":["post-54950","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-u-s-department-of-justice"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.9 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Calif.
