Walter sentenced<\/span> Huizar, 55, of Boyle Heights. The judge also ordered him to pay $38,792 in restitution to the IRS and $443,905 to the City of Los Angeles.<\/span><\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Judge Walter ordered Huizar to surrender to federal authorities before April 30.<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Judge Walter said public corruption carries \u201cthe real potential to destroy the delicate fabric of our democracy\u201d and causes the public \u201cto disengage in the democratic process\u201d and \u201cgive up all hope of participating\u201d with the government.<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Huizar pleaded guilty in January 2023 to one count of conspiracy to violate the Racketeer Influenced and Corrupt Organizations (RICO) Act and one count of tax evasion. He represented Council District 14 (CD-14), which includes downtown Los Angeles and its surrounding communities, from 2005 until his resignation in 2020.<\/span><\/p>\n<p><iframe loading=\"lazy\" title=\"Former L.A. My hope is that this case brings more citizens forward to the FBI when they suspect corrupt practices and foreign influence.\u201d<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Huizar led what prosecutors in court documents called the CD-14 Enterprise for years. <\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">This criminal conspiracy operated a pay-to-play scheme with three key goals: gain financial enrichment through bribes, maintain Huizar\u2019s political power, and avoid detection by law enforcement.<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: 20px;\">With help from others, Huizar sought nearly $2 million in benefits in bribes from real estate developers and their proxies by using his position as CD-14&#8217;s councilmember and chair of the Planning and Land Use Management (PLUM) Committee.\u00a0 He oversaw all significant commercial and residential development projects throughout the entire city.<\/span><\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-6172 alignright\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading-300x228.jpg\" alt=\"\" width=\"409\" height=\"311\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading-300x228.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading-45x35.jpg 45w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/09\/FBI-Insider-Trading.jpg 500w\" sizes=\"auto, (max-width: 409px) 100vw, 409px\" \/>The benefits ranged from cash bribes, casino gambling chips, prostitution services, political contributions, flights on private jets and commercial airlines, stays at luxury hotels and casinos, expensive meals, tickets to concerts and sporting events, and other things of value. <\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">In exchange for these benefits, Huizar used his public office positions to take official actions and give favorable treatment to the projects of the paying real estate developers.<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Huizar facilitated at least five bribery schemes. <\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">In one of the schemes, Huizar solicited $500,000 in cash for himself and his co-conspirators from developer David Lee in exchange for taking an official act to resolve an appeal by a labor organization against Lee\u2019s project. <\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">In another scheme, Huizar accepted more than $1 million in benefits from billionaire real estate developer, Wei Huang, in exchange for pushing future approvals of the redevelopment of Huang\u2019s hotel into the tallest tower west of the Mississippi.\u00a0<\/span><\/p>\n<p><iframe loading=\"lazy\" title=\"\u2018I\u2019d like to ask for forgiveness.\u2019 Former LA Councilman Jos\u00e9 Huizar speaks out\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/SP4oZ8lGHkw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-39979 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2020\/07\/judge-gavel-300x160.jpg\" alt=\"\" width=\"450\" height=\"240\" \/>To keep his political position in jeopardy in 2013, Huizar also devised a plan to covertly transfer $600,000 from Huang in the form of collateral through a foreign shell company, which he then used to settle the lawsuit in confidence.<\/span><\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Huizar similarly concealed his many other bribes, including by laundering cash through his mother and brother, and by omitting his financial benefits on his tax returns.<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">When Huizar\u2019s final term for the CD-14 Council seat was set to expire in 2020, Huizar pushed his wife, who had never held public office, to run as his successor, then used the CD-14 Enterprise and the pay-to-play scheme to extract campaign contributions that would allow him to maintain political power through her. Instead, Huizar, while he was still in office, was ultimately indicted in July 2020 on the charges in this case, and he resigned from his council and committee positions later that year.\u00a0<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">As part of his plea agreement, Huizar also admitted to obstructing justice, including by tampering with two witnesses, and lying to federal prosecutors and federal agents.<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-53774 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/08\/1yeql23dvji-200x300.jpg\" alt=\"brown wooden chairs inside room\" width=\"253\" height=\"380\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/08\/1yeql23dvji-200x300.jpg 200w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/08\/1yeql23dvji-683x1024.jpg 683w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/08\/1yeql23dvji-768x1152.jpg 768w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2023\/08\/1yeql23dvji.jpg 800w\" sizes=\"auto, (max-width: 253px) 100vw, 253px\" \/>In a sentencing memorandum, prosecutors described how Huizar chose \u201cto <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">place his own lust for money and power above the rights and interests of the people he was elected to serve\u201d and \u201c[i]n the wake of his criminal activity\u2026helped gut the public\u2019s confidence in the integrity of its local government \u2013 and beyond \u2013 and eroded a sense of fair play therein.\u201d<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">&#8220;Mr. Huizar was entrusted with making decisions in the best interest of Angelenos.\u00a0 <\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Instead, he leveraged his position to enrich himself and his close allies in a mafia-style organization. His greed further emboldened him to hide his criminally gained profits from the IRS, which was a big mistake,\u201d said Special Agent in Charge Tyler Hatcher, IRS Criminal Investigation, Los Angeles Field Office. \u201cIRS Criminal Investigation is the best in the world at following the money, and by teaming with our federal partners we will aggressively investigate corruption at every level.\u201d<\/span><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><strong><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Other defendants charged alongside Huizar in the indictment are:<\/span><\/strong><\/p>\n<ul>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/real-estate-developer-found-guilty-fraud-bribery-and-obstruction-charges-paying-500000\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Dae Yong Lee<\/a>, 59, a.k.a. \u201cDavid Lee,\u201d of Bel-Air, a real estate developer who is serving a six-year prison sentence for his convictions for honest services wire fraud, bribery, and falsification of records in a federal investigation.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">940 Hill LLC, a Lee-controlled Los Angeles-based company, which was convicted of the same crimes as Lee and sentenced in July 2023 to five years of probation, fined $1.5 million, and ordered to pay the costs of prosecution.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Wei Huang, 58, of Shenzhen, China, a billionaire real estate developer who is charged with several felonies, has yet to make a court appearance in this case and is a fugitive believed to be in China.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/chinese-real-estate-developer-s-la-based-company-found-guilty-paying-over-1-million\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Shen Zhen New World I LLC<\/a>, a downtown Los Angeles-based company convicted \u2013 through the actions of its owner, Huang \u2013 of paying more than $1 million in bribes to Huizar, including the $600,000 sham loan. The company was sentenced in May 2023 to five years of probation, fined $4 million, and ordered to pay the costs of prosecution.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/new-indictment-rico-case-against-former-la-city-councilman-jose-huizar-adds-5\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Raymond She Wah Chan<\/a>, 67, of Monterey Park, a former Los Angeles deputy mayor, has pleaded not guilty to charges of RICO conspiracy, bribery, honest services fraud and lying to federal agents. His retrial is scheduled to begin on March 12.<\/span><\/li>\n<li class=\"yiv0087412960MsoNormal\" style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Other defendants in related criminal cases stemming from this corruption<\/span><\/li>\n<li class=\"yiv0087412960MsoNormal\" style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">matter are:<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/fundraiser-agrees-plead-guilty-federal-corruption-charge-delivering-hundreds-thousands\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Justin Jangwoo Kim<\/a>, 57, of Mar Vista, a political fundraiser who pleaded guilty in June 2020 to one count of bribery and is scheduled for sentencing on June 21.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/lobbyist-agrees-plead-guilty-city-hall-bribery-scheme-which-city-councilman-jose-huizar\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Morris Roland Goldman<\/a>, 61, of Porter Ranch, a lobbyist who pleaded guilty in September 2020 to one count of conspiracy to commit bribery and honest services fraud and is scheduled for sentencing on July 12.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/consultant-agrees-plead-guilty-rico-offense-related-bribery-scheme-enriched-la-city\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">George Chiang<\/a>, 45, of Granada Hills, a real estate development consultant who pleaded guilty in June 2020 to one count of racketeering conspiracy and is scheduled for sentencing on July 19.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/former-aide-la-city-councilmember-agrees-plead-guilty-rico-charge-stemming-pay-play\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">George Esparza<\/a>, 37, of Boyle Heights,<b>\u00a0<\/b>Huizar\u2019s former special assistant, who pleaded guilty in July 2020 to one count of racketeering conspiracy and is scheduled for sentencing on July 26.<\/span><\/li>\n<li style=\"text-align: left;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/brother-former-la-city-councilman-jos-huizar-admits-lying-investigators-about\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Salvador Huizar<\/a>, 57, of Boyle Heights, Jos\u00e9 Huizar\u2019s brother, who testified as a witness for the prosecution in the Shen Zhen trial and pleaded guilty in October 2022 to a felony charge of making false statements to federal investigators. His sentencing hearing is scheduled for August 2.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><strong><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">The FBI investigated this matter with assistance from IRS Criminal Investigation.<\/span><\/strong><\/p>\n<p class=\"yiv0087412960MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Assistant U.S. Attorney Mack E.
