He was also convicted to attacking an electrical substation in Orange. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Further, he admitted to plotting an attack on Dodger Stadium last year on a night celebrating LGBTQ pride.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Tibet Ergul,\u00a022, of Irvine, pleaded guilty to one felony count of conspiracy to damage an energy facility and one misdemeanor count of intentional damage to a reproductive health services facility.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0 U.S. District Judge Cormac J. Carney scheduled a May 30 sentencing hearing. Ergul faces up to 21 years in federal prison. This reminds us of why it is critical that all of us unite against hate in our community.\u201d\u00a0 \u00a0<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u201cMr. Ergul put lives at risk when he firebombed the clinic and yet continued to plan acts that had the potential to cause death and destruction,\u201d said Amir Ehsaei, the Acting Assistant Director in Charge of the FBI&#8217;s Los Angeles Field Office, S<\/span><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">pecial Agent in Charge Todd Battaglia of the NCIS Marine West Field Office. \u201cThis case should serve as a warning to those who perpetrate acts of terror against our fellow Americans and hate that threatens access to reproductive health services.\u201d<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-1611 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/FBI-Logo-300x209.jpg\" alt=\"\" width=\"300\" height=\"209\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/FBI-Logo-300x209.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/03\/FBI-Logo.jpg 500w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>According to his plea agreement, in February and March of 2022, Ergul and Chance Brannon,\u00a024, of San Juan Capistrano, agreed to use a Molotov cocktail to damage a Planned Parenthood clinic in Orange County.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"> Ergul and Brannon, who at the time was an active-duty United States Marine, targeted the clinic because it provided reproductive health services, and they wanted to encourage others to engage in similar violent acts. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Ergul and Brannon also wanted to make a statement about abortion, scare pregnant women away from obtaining abortions, deter doctors, staff, and employees at the clinic from providing abortions, and intimidate the clinic\u2019s patients.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 On March 12, 2022, in Ergul\u2019s garage, Ergul and Brannon knowingly assembled a Molotov cocktail. During the early morning hours of March 13, Ergul and Brannon \u2013 disguised in dark clothing, masks, hoods, and gloves \u2013 drove to a Planned Parenthood clinic in Costa Mesa, ignited the Molotov cocktail, and threw it at the clinic\u2019s entrance, intentionally starting a fire. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Due to the fire and the damage it caused, the clinic was forced to close and reschedule about 30 patient appointments temporarily.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ergul further admitted that in June 2022, following the Supreme Court\u2019s decision to overturn\u00a0<i>Roe v. Wade<\/i>, he and Brannon planned to use a second Molotov cocktail to attack another Planned Parenthood clinic. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Ergul and Brannon abandoned this plan after seeing law enforcement near the targeted clinic.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ergul also conspired with others, including Brannon, to damage a Southern California Edison electrical substation to debilitate Orange County\u2019s power grid. Ergul and his accomplices planned to attack the substation by using firearms or a Molotov cocktail that Ergul possessed in his garage. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Ergul and Brannon consulted with an associate about surveillance, drone operations and firearms. In March 2023, Ergul messaged an associate to say he had found a substation in Orange to target.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\"> Ergul sent the associate aerial photographs of the substation and suggested doing a \u201cdrive-thru\u201d at 3 a.m. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Ergul also sent Brannon a letter in which he wrote: \u201cThe rifle is in a box in my room waiting to be used in the upcoming race war,\u201d and he discussed a desire to murder politicians and journalists. Ergul and Brannon did not carry out this attack before their arrest in this case.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 During the early summer of 2023, Ergul and Brannon also discussed and researched how to attack the Dodger Stadium parking lot or the stadium\u2019s electrical room on a night celebrating LGBTQ pride, including by using a device that could be detonated remotely, Ergul admitted in his plea agreement. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"font-size: 20px;\">Brannon and Ergul exchanged sabotage manuals and discussed doing \u201cdry runs\u201d to \u201ccase\u201d the stadium.\u00a0 Law enforcement arrested Ergul and Brannon two days before Dodger Stadium\u2019s scheduled \u201cPride Night.\u201d<\/span><span style=\"font-size: 20px;\">\u00a0 \u00a0 \u00a0 \u00a0 \u00a0\u00a0<\/span><\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Ergul, who has been in federal custody since June 2023, is the third and final defendant to plead guilty in this case.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Brannon, who also has been in federal custody since June 2023,\u00a0<a href=\"https:\/\/www.justice.gov\/usao-cdca\/pr\/former-us-marine-pleads-guilty-firebombing-planned-parenthood-clinic-orange-county-and\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">pleaded guilty<\/a> in November to four crimes: conspiracy, malicious destruction of property by fire and explosives, possession of an unregistered destructive device, and intentional damage to a reproductive health services facility.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">This is a violation of the Freedom of Access to Clinic Entrances Act. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Brannon\u2019s sentencing hearing is scheduled for April 15.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Xavier Batten,\u00a021,\u00a0of Brooksville, Florida, who has been in federal custody since July 2023, pleaded guilty on January 19 to one count of possession of an unregistered destructive device and one count of intentional damage to a reproductive health services facility. <\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">Batten\u2019s sentencing hearing is scheduled for May 15.<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 The FBI\u2019s Joint Terrorism Task Force and the Naval Criminal Investigative Service investigated this matter.\u00a0<\/span><\/p>\n<p class=\"yiv8809655632MsoNormal\" style=\"text-align: center;\"><span style=\"font-size: 20px; font-family: arial, helvetica, sans-serif;\">\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 Assistant U.S. Attorney Kathrynne N.
