Dellums Federal Building and U.S. Courthouse in Oakland, California<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The shooting resulted in the murder of Protective Services Officer (PSO) Dave Patrick Underwood and the attempted murder of a second PSO.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"> In 2022, Justus\u2019s co-defendant, Steven Carrillo, was <a href=\"https:\/\/www.justice.gov\/usao-ndca\/pr\/steven-carrillo-sentenced-41-years-prison-murder-and-attempted-murder-role-drive\">sentenced to 41 years in prison<\/a> followed by a lifetime of supervised release for his role in the crimes, according to authorities.<\/span><\/p>\n<figure id=\"attachment_55820\" aria-describedby=\"caption-attachment-55820\" style=\"width: 224px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-55820 size-medium\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2024\/03\/EBT-L-JUSTUS-0316-2-1-224x300.webp\" alt=\"\" width=\"224\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2024\/03\/EBT-L-JUSTUS-0316-2-1-224x300.webp 224w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2024\/03\/EBT-L-JUSTUS-0316-2-1-300x401.webp 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2024\/03\/EBT-L-JUSTUS-0316-2-1.webp 620w\" sizes=\"auto, (max-width: 224px) 100vw, 224px\" \/><figcaption id=\"caption-attachment-55820\" class=\"wp-caption-text\">Robert Alvin Justus Jr.<\/figcaption><\/figure>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cWith this sentence, the Justice Department has ensured that both of the defendants responsible for brutally murdering a law enforcement officer and seriously wounding another are held accountable for their heinous crimes,\u201d said Attorney General Merrick B. Garland. \u201cLaw enforcement officers serve their communities at great risk to themselves, and anyone who targets these brave men and women will be met with the full force of the Justice Department.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">According to court documents, Justus was convicted by a jury of aiding and abetting the murder and attempted murder following a two-week trial. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The evidence established that Justus was the driver of the vehicle from which Steven Carrillo, 35, of Santa Cruz, fired the gunshots that killed Officer Underwood and wounded the second officer.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">On May 29, 2020, at approximately 9:27 p.m., Justus parked a white Ford Econoline van directly across the street from the federal courthouse building in Oakland on Jefferson Street. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-42276 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/03\/courtroom-1-300x225.jpg\" alt=\"\" width=\"300\" height=\"225\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/03\/courtroom-1-300x225.jpg 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2021\/03\/courtroom-1.jpg 640w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>The van was on the southeast corner closest to the intersection with an unobstructed view of the guard post where Officer Underwood and his partner stood guard to protect the building and its occupants that evening. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">At approximately 9:44 p.m., the exterior lights of the van turned on and Justus drove the van north on Jefferson Street toward the guard post. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The passenger-side sliding door opened, and Carrillo fired numerous rounds from an AR-style rifle toward the guard post, killing Officer Underwood and seriously injuring his partner. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The image below shows the shooting in progress as Justus drove the white van across the intersection from a courthouse security camera and was in evidence at trial.<\/span><\/p>\n<div class=\"align-center entity-type-media entity-bundle-image media--image--embedded entity-image-1343976\" style=\"text-align: center;\">\n<div class=\"field__item img_wrp\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" title=\"From a courthouse security camera, the image shows the shooting in progress as Justus drove the white van across the intersection\" src=\"https:\/\/www.justice.gov\/d9\/styles\/banner\/public\/2024-03\/ndca_justus_intersection_camera.jpg?itok=wIhZ3SsW\" alt=\"A picture of a four-way intersection at night with cars and trees lining the road.\" width=\"1420\" height=\"687\" \/><\/span><\/div>\n<\/div>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The trial ending in Justus\u2019s conviction contained ominous evidence of the leadup to participation in the drive-by shooting. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">For example, Justus and Carrillo shared an allegiance to an anti-government movement called Boogaloo. In February 2020, Justus commented on Facebook that he had a \u201cbloodlust for police,\u201d and in April 2020, he corresponded with an armed anti-government militia group he was interested in joining. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">On May 27, 2020, Justus posted an image depicting a police officer being shot in the head with a caption reading \u201cSpeak to cops in a language they understand.\u201d <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">In addition, on the day before the shooting, Carrillo posted a video of a mob attacking police cruisers and commented, \u201c[T]his needs to be nationwide. It\u2019s a great opportunity to target the specialty soup bois\u201d \u2013 a Boogaloo slang term for federal agents. Justus responded to Carrillo\u2019s post that same day, writing \u201cLet\u2019s boogie.\u201d\u00a0<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The trial evidence demonstrated that, on the day of the shooting, Carrillo and Justus planned to capitalize on protests being planned in Oakland in response to the death of George Floyd. They hoped their attack would spark further anti-government violence. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Carrillo and Justus met in a parking lot in San Leandro before the two circled the downtown area in Oakland several times. In the hour leading up to the shooting, Justus exited the van twice to scout the area on foot and locate targets.<\/span><\/p>\n<p><iframe loading=\"lazy\" title=\"Ex-Air Force sergeant pleads guilty to killing guard at California federal building\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/SW3y4QqAG0w?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Investigators from the FBI, Oakland Police Department and other agencies located security video footage from numerous locations throughout Oakland showing Justus\u2019s movements on both occasions when he left the white van but returned before the shooting. After the shooting, Justus drove Carrillo back to Millbrae and the two separated.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The incident set off an eight-day manhunt. During this time, Justus destroyed digital and physical evidence connecting him to the shooting, continued to post anti-law enforcement content on Facebook and corresponded with Carrillo about meeting in the future. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Eventually, Carrillo was captured at his residence in Ben Lomond, California, but not before Carrillo killed a Santa Cruz Sheriff\u2019s Deputy and injured another. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Several days later, Justus became aware that he was under investigation and traveled to the Federal Building in San Francisco, where he met with the FBI and admitted to his involvement in the shooting.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">On Feb. 11, 2022, Carrillo pleaded guilty to two federal charges related to the May 29, 2020, shooting \u2013 use of a firearm in furtherance of a crime of violence resulting in death and attempted murder of a person assisting an officer of the U.S. government. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">On June 3, 2022, Judge Gonzalez Rogers\u00a0<a href=\"https:\/\/www.justice.gov\/usao-ndca\/pr\/steven-carrillo-sentenced-41-years-prison-murder-and-attempted-murder-role-drive\">sentenced Carrillo to serve 41 years in prison<\/a>\u00a0followed by a lifetime of supervised release for his role in the crimes. <\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Carrillo also received a life sentence in Santa Cruz County Superior Court in connection with his murder of the Santa Cruz Sheriff\u2019s Deputy.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The FBI, Bureau of Alcohol, Tobacco, Firearms and Explosives, Federal Protective Service, and U.S. Marshals Service investigated the case.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Assistant U.S. Attorneys Jonathan U. Lee and John C. Bostic for the Northern District of California prosecuted the case.<\/span><\/p>\n<p style=\"text-align: center;\">\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Officials stated
