{"id":57610,"date":"2024-09-26T11:40:52","date_gmt":"2024-09-26T18:40:52","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=57610"},"modified":"2024-09-27T09:20:30","modified_gmt":"2024-09-27T16:20:30","slug":"department-of-justice-investigating-lexington-police-department-for-discrimination-illegal-arrests-and-other-civil-rights-violations","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=57610","title":{"rendered":"Federal Investigation:  Lexington Police Department Discriminates, Makes Illegal Arrests, Stops and Searches and Other Civil Rights Violations"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-3918 alignleft\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice-300x300.png\" alt=\"Two Men Arrested for Allegedly Operating One of the Largest Synthetic Drug Smuggling Rings\" width=\"300\" height=\"300\" srcset=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice-300x300.png 300w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice-150x150.png 150w, https:\/\/cjnotebook.com\/wp-content\/uploads\/2014\/06\/Department-of-Justice.png 350w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/>After a thorough investigation, the U.S. Justice Department announced Thursday that the City of Lexington, Mississippi, and its Police Department have been violating people&#8217;s constitutional and federal rights.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Lexington is a small town of about 1,200 people, located an hour from Jackson, Mississippi.<\/span><\/p>\n<p style=\"text-align: center;\"><strong><span style=\"font-size: 20px;\">Specifically, the Justice Department finds that LPD unlawfully<\/span><\/strong><\/p>\n<ul>\n<li><span style=\"font-size: 20px;\">Arrests, jails and detains people who cannot pay fines or fees, without assessing their ability to pay<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Uses excessive force<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Conducts stops, searches and arrests without probable cause, including jailing people on illegal \u201cinvestigative holds\u201d and arresting people solely because they owe outstanding fines<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Imposes money bail without justification or assessment of ability to pay<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Jails people without prompt access to court<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Violates the rights of people engaged in free speech and expression, including by retaliating against people who criticize the police<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Discriminates against Black people<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Operates under an unconstitutional conflict of interest because LPD\u2019s funding depends on the money it raises through its enforcement<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 20px;\">In addition, the investigation about the city assessing accessive fines and fees:<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 20px;\">LPD\u2019s enforcement has left hundreds of residents in debt, with over $1.7 million in outstanding fines in a town of just 1,200 people<\/span><\/li>\n<li><span style=\"font-size: 20px;\">LPD lacks an accountability system, and those facing charges, especially the poor, often don\u2019t have access to legal counsel, allowing misconduct to continue<\/span><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The Civil Rights Division and the U.S. Attorney&#8217;s Office for the Southern District of Mississippi led the Justice Department&#8217;s investigation, which got underway on November 8, 2023.<\/span><\/p>\n<p style=\"text-align: center;\"><strong><span style=\"font-size: 20px;\">To Read the Entire DOJ Investigation Report Click Here<\/span>: <span style=\"font-size: 20px;\"><a href=\"https:\/\/www.justice.gov\/sites\/default\/files\/opa\/press-releases\/attachments\/2015\/03\/04\/ferguson_police_department_report.pdf\">DOJ<\/a><\/span><\/strong><\/p>\n<p><iframe loading=\"lazy\" title=\"DOJ Investigation Uncovers Policing for Profit &amp; Garland. \u201cThe Justice Department\u2019s investigation uncovered that Lexington police officers have engaged in a pattern or practice of discriminating against the city\u2019s Black residents, used excessive force, and retaliated against those who criticize them.&#8221;<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">&#8220;Additionally, Lexington\u2019s approach to fines and fees \u2014 including unlawfully arresting, jailing, and detaining people based on their failure to pay money without assessing if they can afford to do so \u2014 has been devastating for its residents. Being poor is not a crime, but practices like these amount to punishing people for poverty. I\u2019m grateful to the Civil Rights Division for its thorough investigation and continued work to address these findings.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cLexington is a small, rural community, but its police department has had a heavy hand in people\u2019s lives, wreaking havoc through use of excessive force, racially discriminatory policing, retaliation, and more. In every corner of our country, police officers must respect people\u2019s constitutional rights and treat people with dignity,\u201d said Assistant Attorney General Kristen Clarke of the Justice Department\u2019s Civil Rights Division.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">Clarke added, \u201cAfter an extensive review, we found that police officers in Lexington routinely make illegal arrests, use brutal and unnecessary force, and punish people for their poverty \u2014 including by jailing people who cannot afford to pay fines or money bail. For too long, the Lexington Police Department has been playing by its own rules and operating with impunity \u2014 it\u2019s time for this to end. Our findings report furthers the Justice Department\u2019s commitment to ensuring fairness and the rule of law.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">\u201cPolice have the authority to enforce the law, not to act as debt collectors for the City, extracting payments from the poor with threats of jail,\u201d said U.S. Attorney Todd Gee for the Southern District of Mississippi. \u201cNo matter how large or small, every police department has an obligation to follow the Constitution.\u201d<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\"><strong>The investigation indicated the following:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 20px;\">LPD has made nearly one arrest for every four residents in the past two years, mainly for minor offenses and traffic violations.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">This arrest rate is over 10 times higher than the state average.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">Many arrests were for non-criminal acts, such as unpaid fines or using profanity.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">The majority of those arrested are Black, and in 2023, Black people were 17.6 times more likely to be arrested than white people.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">LPD used excessive force in minor cases, such as breaking down a door to arrest a man for swearing at an official.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">In one instance, officers tased a man for 15 seconds after following him home for a tinted windshield violation.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">On the day the Justice Department launched its investigation, LPD officers tased a man nine times for disturbing a business.<\/span><\/li>\n<\/ul>\n<p><iframe loading=\"lazy\" title=\"Shocking, Racist Audio of Fired Mississippi Police Chief Released\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/AtTAPwUN2OA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p style=\"text-align: center;\"><strong>(July 2022 News Report)<\/strong><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">In February, while the investigation was ongoing, the department\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-informs-city-lexington-and-lexington-police-department-automatically\">issued a letter<\/a>\u00a0to the City of Lexington raising significant concerns regarding their practice of jailing people for unpaid fines without first assessing whether they can afford to pay them.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The City and LPD cooperated fully with the investigation.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The City and LPD have committed to working cooperatively with the department to address the violations identified in the department\u2019s findings.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 20px;\">The department will be conducting outreach to members of the Lexington community for input on remedies to address the department\u2019s findings.
