And that alone would\u2019ve been enough to shut the door.<\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"1005\" data-end=\"1186\" data-speechifyplaybackhighlighter-highlight=\"true\"><span style=\"font-size: 20px;\">But the judge went further. He hammered home what used to be considered Civics 101: <strong data-start=\"1089\" data-end=\"1150\">Even non-citizens on U.S. soil have constitutional rights<\/strong>. Chief among them? <strong data-start=\"1170\" data-end=\"1185\">Due process<\/strong>.<\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"1188\" data-end=\"1552\"><span style=\"font-size: 20px;\">The administration\u2019s shortcut around hearings, evidence, and legal notice wasn\u2019t just sloppy\u2014it was illegal. Briones slammed the government\u2019s claims as &#8220;a wasting of judicial resources,&#8221; pointing out they didn\u2019t even bother to present credible proof that the individuals were gang members. It wasn\u2019t national security. It was political theater masquerading as law.<\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"1554\" data-end=\"1868\"><span style=\"font-size: 20px;\">Even more damning was Briones\u2019 reminder that <strong data-start=\"1599\" data-end=\"1632\">presidents don\u2019t write checks<\/strong>. Appropriations belong to Congress. Trump\u2019s maneuver to reroute funds and bypass the legislative branch violated the sacred separation of powers. It\u2019s a theme that has echoed through courtrooms for years, but rarely with this much fire.<\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"1870\" data-end=\"2313\"><span style=\"font-size: 20px;\">The ruling has immediate consequences. <strong>The government is now blocked from deporting any alleged Tren de Aragua member from the Western District of Texas under the Alien Enemies Act unless it follows proper legal channels. <\/strong><\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"1870\" data-end=\"2313\"><span style=\"font-size: 20px;\">Judge Briones also certified the ruling as a <strong data-start=\"2131\" data-end=\"2147\">class action<\/strong>, giving broad protection to anyone similarly targeted.\u00a0<strong data-start=\"2223\" data-end=\"2267\"><span style=\"box-sizing: border-box; margin: 0; padding: 0; text-align: left;\">Moving forward,\u00a0<strong>the government must provide<\/strong><\/span>\u00a030 days&#8217; notice<\/strong> before attempting to remove any individual under this law.<\/span><\/p>\n<p style=\"text-align: center;\" data-start=\"2315\" data-end=\"2533\"><span style=\"font-size: 20px;\">Let\u2019s be clear: This ruling doesn\u2019t hand out free passes to undocumented immigrants. The government still has every right to use <strong data-start=\"2444\" data-end=\"2473\">standard immigration laws<\/strong>. What it can\u2019t do is shred the Constitution in the process.<\/span><\/p>\n<p style=\"text-align: center;\" title=\"\" data-start=\"2535\" data-end=\"2674\"><span style=\"font-size: 20px;\">Judge Briones\u2019 opinion is a reminder that <strong data-start=\"2577\" data-end=\"2615\">fear doesn\u2019t trump the rule of law<\/strong>, and border policy doesn\u2019t get a constitutional exemption.<\/span><\/p>\n<p style=\"text-align: center;\" title=\"\" data-start=\"2676\" data-end=\"2744\" data-is-last-node=\"\" data-is-only-node=\"\" data-speechifyclicktoplay-highlight=\"true\" data-speechifyclicktoplay-no-background=\"true\"><span style=\"font-size: 20px;\">In times like these, that\u2019s not just a legal point\u2014it\u2019s a moral
