{"id":9880,"date":"2015-03-06T18:32:34","date_gmt":"2015-03-07T02:32:34","guid":{"rendered":"https:\/\/cjnotebook.com\/?p=9880"},"modified":"2015-03-06T18:54:31","modified_gmt":"2015-03-07T02:54:31","slug":"two-women-convicted-of-scamming-insurance-companies-of-more-than-50-million","status":"publish","type":"post","link":"https:\/\/cjnotebook.com\/?p=9880","title":{"rendered":"Two Women Convicted of Scamming Insurance Companies of More Than $50 Million"},"content":{"rendered":"<p><strong><a href=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/courtroom_02.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-8558\" src=\"https:\/\/cjnotebook.com\/wp-content\/uploads\/2015\/01\/courtroom_02-150x150.jpg\" alt=\"courtroom_02\" width=\"150\" height=\"150\" \/><\/a>\u00a0SANTA ANA, CALIF.<\/strong>\u00a0\u2013\u00a0A federal jury convicted two Southern California residents in connection with a scheme to defraud union and private health insurance programs by submitting bills for more than $71 million \u2013 and receiving over $50 million in payments \u2013 for medically unnecessary procedures performed on insurance beneficiaries who received free or discounted cosmetic surgeries, officials said.<\/p>\n<p>A large number of the fraudulent claims were submitted to the<strong> International Longshore and Warehouse Union and Operating Engineers Union<\/strong> health insurance plans. Other victim insurers included <strong>Aetna<\/strong> and <strong>Anthem.<\/strong><\/p>\n<p>The two defendants are\u00a0<strong>Theresa Fisher<\/strong>, 45, of Tustin, who was found guilty of five counts of mail fraud; and<strong>\u00a0Lindsay Hardgraves<\/strong>, 30, of San Pedro, who was found guilty of two counts of mail fraud.<\/p>\n<p>At sentencing, each defendant is facing up to 20 years in federal prison for each count of mail fraud.<\/p>\n<p>U.S.District Judge Josephine L. Staton will sentence Fisher and Hardgraves on May 29.<\/p>\n<p><strong>The evidence presented during a six-day trial showed the following facts:<\/strong><\/p>\n<ul>\n<li>\u00a0Members of the scheme lured insured \u201cpatients\u201d to a surgery center in Orange with promises that they could use their union or PPO health insurance plans to pay for cosmetic surgeries, which are generally not covered by insurance, officials said.<\/li>\n<li>The surgery center was known at various times as <strong>Princess Cosmetic Surgery<\/strong>, <strong>Vista Surgical Center,<\/strong> and <strong>Empire Surgical Center.<\/strong><\/li>\n<li>Marketers such as Hardgraves referred \u201cpatients\u201d to the surgery center, where they were told they could receive free or discounted cosmetic surgeries if they underwent multiple, medically unnecessary procedures that would be billed to their union or PPO health care benefit program.<\/li>\n<li>Fisher was a consultant at the surgery center who scheduled procedures after telling the \u201cpatients\u201d about the free cosmetic procedures they could receive and coaching them to fabricate or exaggerate symptoms so that their medical procedures would be covered by their insurance.<\/li>\n<li>The unnecessary procedures typically performed on the \u201cpatients\u201d were endoscopies (usually sophagogastroduodenoscopies, or EGDs), colonoscopies and cystoscopies.<\/li>\n<li>Once the health care benefit program paid the claims, the patients were given free or discounted cosmetic surgeries, including \u201ctummy tucks,\u201d breast augmentations and liposuction.<\/li>\n<li>In some cases, the surgery center simply billed cosmetic procedures (such as tummy tucks) as if they were medically necessary procedures (such as hernia surgeries).<\/li>\n<\/ul>\n<p>A third defendant in this case \u2013<strong> Vi Nguyen,<\/strong> 31, of Placentia, another consultant at the surgery center \u2013 pleaded guilty in January to four counts of mail fraud and faces sentencing before Judge Staton on July 10.<\/p>\n<p>At sentencing, each defendant faces up to 20 years in federal prison for each count of mail
